유통산업발전법 제12조의2(대규모점포등에 대한 영업시간의 제한 등)

① 특별자치시장ㆍ시장ㆍ군수ㆍ구청장은 건전한 유통질서 확립, 근로자의 건강권 및 대규모점포등과 중소유통업의 상생발전(相生發展)을 위하여 필요하다고 인정하는 경우 대형마트(대규모점포에 개설된 점포로서 대형마트의 요건을 갖춘 점포를 포함한다)와 준대규모점포에 대하여 다음 각 호의 영업시간 제한을 명하거나 의무휴업일을 지정하여 의무휴업을 명할 수 있다. 다만, 연간 총매출액 중 「농수산물 유통 및 가격안정에 관한 법률」에 따른 농수산물의 매출액 비중이 55퍼센트 이상인 대규모점포등으로서 해당 지방자치단체의 조례로 정하는 대규모점포등에 대하여는 그러하지 아니하다.

② 특별자치시장ㆍ시장ㆍ군수ㆍ구청장은 제1항제1호에 따라 오전 0시부터 오전 10시까지의 범위에서 영업시간을 제한할 수 있다.

③ 특별자치시장ㆍ시장ㆍ군수ㆍ구청장은 제1항제2호에 따라 매월 이틀을 의무휴업일로 지정하여야 한다. 이 경우 의무휴업일은 공휴일 중에서 지정하되, 이해당사자와 합의를 거쳐 공휴일이 아닌 날을 의무휴업일로 지정할 수 있다.
