유류오염손해배상 보장법 제39조(소송절차의 중지)

① 제41조에서 준용하는 「선박소유자 등의 책임제한절차에 관한 법률」 제43조에 따라 신고한 제한채권에 관하여 그 채권의 채권자와 신청인 또는 수익채무자 간에 소송이 계속 중인 때에는 법원은 국제기금이 그 소송에 참가하고 있거나 제23조제1항에 따른 고지를 받은 경우에는 원고의 신청을 받아서 하거나 직권으로 그 소송절차의 중지를 명할 수 있으며, 그 외의 경우에는 원고의 신청을 받아 그 소송절차의 중지를 명할 수 있다.

② 제38조제2항에서 준용하는 「선박소유자 등의 책임제한절차에 관한 법률」 제43조에 따라 신고한 제한채권에 관하여 국제기금협약 제4조제1항에 따른 보상을 청구하기 위한 국제기금에 대한 소송이 계속 중인 때에는 법원은 직권으로 그 소송절차의 중지를 명할 수 있다.

③ 제1항의 경우 원고의 신청을 받아 소송절차의 중지를 명한 때에는 법원은 원고의 신청을 받아 그 소송절차의 중지결정을 취소할 수 있다.
