Enforcement Decree of the Act on the Protection, Use, etc. of Location Information, Article 35 (Periodic Inspection of Actual Conditions)

① 방송미디어통신위원회가 법 제36조제3항에 따라 실시하는 실태 정기점검에는 다음 각 호의 사항이 포함되어야 한다. <개정 2025.10.1>

③ 방송미디어통신위원회가 제1항에 따른 실태 정기점검을 하는 경우에는 점검의 목적ㆍ대상ㆍ방법ㆍ기간 등을 포함한 점검계획을 점검 시작 7일 전까지 점검대상자에게 서면으로 통보해야 한다. 다만, 개인위치정보의 침해사고가 발생하거나 개인위치정보의 침해에 관한 구체적인 민원이 제기되어 긴급히 점검할 필요가 있는 경우에는 통보하지 않을 수 있다. <개정 2025.10.1>
