위생용품 관리법 시행령 제13조(권한 등의 위임 및 위탁)
Enforcement Decree of the Hygiene Products Management Act, Article 13 (Delegation and Entrustment of Authority, etc.)
① 식품의약품안전처장은 법 제29조제1항에 따라 다음 각 호의 권한을 지방식품의약품안전청장에게 위임한다. <개정 2024.8.6, 2026.5.6>
(1) Under Article 29 (1) of the Act, the Minister of Food and Drug Safety delegates the following authority to the Director of the Regional Food and Drug Administration:
1. 법 제3조에 따른 위생용품수입업의 신고의 수리 및 처리 지연 사유 통지
1. Acceptance of reports of the hygiene products import business under Article 3 of the Act and notification of grounds for delay in processing;
2. 법 제4조에 따른 휴업ㆍ폐업 및 재개업 신고 접수 등
2. Receipt of reports of suspension, closure, and resumption of business under Article 4 of the Act, etc.;
3. 법 제6조에 따른 지위승계 신고의 수리 및 처리 지연 사유 통지
3. Acceptance of reports of succession to status under Article 6 of the Act and notification of grounds for delay in processing;
4. 법 제8조에 따른 수입 위생용품의 신고의 수리 및 검사 등
4. Acceptance of reports on imported hygiene products and inspection, etc. under Article 8 of the Act;
5. 법 제14조제1항에 따른 보고ㆍ출입ㆍ검사 및 수거 등
5. Reports, entry, inspection, and collection, etc. under Article 14 (1) of the Act;
6. 법 제14조제2항에 따른 검사 결과의 통보
6. Notification of inspection results under Article 14 (2) of the Act;
7. 법 제15조에 따른 시정명령
7. Corrective orders under Article 15 of the Act;
8. 법 제16조제1항 및 제2항에 따른 압류ㆍ폐기
8. Seizure and disposal under Article 16 (1) and (2) of the Act;
8의2. 법 제16조제2항에 따른 회수ㆍ폐기 또는 그 밖의 필요한 조치 명령
8-2. Orders for recall, disposal, or other necessary measures under Article 16 (2) of the Act;
9. 법 제17조에 따른 영업정지 또는 영업소 폐쇄 명령

13. Matters concerning the operation of hygiene products inspectors under Article 26 of the Act;
14. 법 제27조에 따른 소비자위생용품위생감시원의 위촉 및 운영에 관한 사항
14. Matters concerning the commissioning and operation of consumer hygiene products inspectors under Article 27 of the Act;
14의2. 법 제28조의2제1항에 따른 위생증명서 등의 발급 신청의 접수 및 발급
14-2. Receipt and issuance of applications for hygiene certificates, etc. under Article 28-2 (1) of the Act;
15. 법 제30조에 따른 수수료의 징수
15. Collection of fees under Article 30 of the Act;
16. 법 제34조제1항제1호 및 제4호에 따른 과태료의 부과 및 징수
16. Imposition and collection of administrative fines under Article 34 (1) 1 and 4 of the Act.
② 식품의약품안전처장은 법 제29조제2항에 따라 다음 각 호의 업무를 「식품위생법」 제67조제1항에 따라 설립된 식품안전정보원에 위탁한다. <신설 2026.5.6>
(2) Under Article 29 (2) of the Act, the Minister of Food and Drug Safety entrusts the following affairs to the Korea Food Safety Information Service established under Article 67 (1) of the Food Sanitation Act:
1. 법 제28조의3제1항에 따른 위생용품수입정보시스템의 운영
1. Operation of the hygiene products import information system under Article 28-3 (1) of the Act;
2. 제4조의2에 따른 자동화된 방식의 위생용품 수입신고 수리의 적정성 확인 업무
2. Work of verifying the appropriateness of acceptance of import reports for hygiene products by automated means under Article 4-2.
