위기 임신 및 보호출산 지원과 아동 보호에 관한 특별법 시행령 제7조(출생증서의 공개)

① 법 제17조제1항에 따라 출생증서 공개를 청구하려는 사람은 보건복지부령으로 정하는 바에 따라 「아동복지법」 제10조의2에 따른 국가아동권리보장원(이하 "국가아동권리보장원"이라 한다)의 장에게 문서 또는 구두로 신청할 수 있다. <개정 2026.5.6>

② 법 제17조제2항 후단에 따라 국가아동권리보장원의 장으로부터 확인 요청을 받은 신청인 또는 생부는 그 확인 요청을 받은 날부터 14일 이내에 출생증서 중 인적사항의 공개에 대한 동의 여부를 보건복지부령으로 정하는 바에 따라 국가아동권리보장원의 장에게 통보해야 한다. 이 경우 해당 기한까지 동의가 없는 경우에는 동의하지 않는 것으로 본다. <개정 2026.5.6>

③ 국가아동권리보장원의 장은 법 제17조제2항에 따라 신청인 또는 생부의 동의 여부를 확인하기 위하여 필요한 경우에는 주민등록ㆍ가족관계등록ㆍ출입국 등 관련 전산망 또는 자료를 관장하는 관계 기관의 장에게 신청인 또는 생부의 소재지 등을 확인하여 줄 것을 요청할 수 있다. <개정 2026.5.6>

④ 법 제17조제3항에서 "보호출산을 통하여 태어난 사람의 의료상 목적 등 대통령령으로 정하는 특별한 사유"란 보호출산을 통하여 태어난 사람의 진단ㆍ치료 등 생명과 건강의 중대한 이익을 위하여 출생증서 공개가 필요하다고 보건복지부장관이 인정하는 경우를 말한다.

⑤ 국가아동권리보장원의 장은 법 제17조제2항 및 제3항에 따라 출생증서를 공개하는 경우에는 다음 각 호의 방법으로 공개한다. 이 경우 전자문서 형태로 보유하지 않는 정보에 대하여 같은 조 제1항에 따라 출생증서 공개를 청구한 사람이 전자문서 형태로 공개하여 줄 것을 요청하는 경우 그 정보의 성질이 훼손될 우려가 없으면 정보를 전자적 형태로 변환하여 공개해야 한다. <개정 2026.5.6>
