원자력 손해배상법 제8조(손해배상청구권의 우선)

① 피해자는 손해배상을 청구할 때에 보험금에 대하여 다른 채권자보다 우선하여 변제받을 권리가 있다.

② 피보험자는 피해자에 대한 손해배상액에 관하여 자기가 지급한 한도 또는 피해자가 승낙한 한도에서만 보험자에게 보험금의 지급을 청구할 수 있다.

③ 원자력손해배상 책임보험계약의 보험금지급청구권은 양도하거나 담보로 제공하거나 압류할 수 없다. 다만, 피해자가 손해배상청구권에 관하여 압류하는 경우에는 그러하지 아니한다.
