우주항공청의 설치 및 운영에 관한 특별법 제14조(주식의 매각 또는 신탁에 대한 특례)

① 우주항공청장은 재산공개대상임기제공무원에 대하여 주식 보유의 필요성 및 주식 매각이 어려운 사유가 소명된 경우에는 「공직자윤리법」 제14조의4부터 제14조의14까지를 적용하지 아니할 수 있다.

② 제1항에 따라 「공직자윤리법」 제14조의4부터 제14조의14까지를 적용하지 아니하려는 경우에는 윤리위원회의 심의를 거쳐야 한다.

③ 재산공개대상임기제공무원은 재직기간 동안 본인 또는 그 이해관계자(「공직자윤리법」 제4조제1항제2호 또는 제3호에 해당하는 사람을 말하되, 같은 항 제3호의 사람 중 같은 법 제12조제4항에 따라 재산신고사항의 고지를 거부한 사람은 제외한다. 이하 같다)가 보유하고 있는 주식과 관련하여 해당 주식을 발행한 기업의 경영 또는 재산상 권리에 영향을 미칠 수 있는 직무에 결재, 지시, 의견표명 등의 방법을 통하여 관여하여서는 아니 된다. 다만, 법령에서 해당 직무를 직접 수행하도록 규정하고 있는 경우 등 직무에 관여하지 아니하는 것이 불가능한 경우는 제외한다.

④ 재산공개대상임기제공무원은 제3항 본문에 따라 직무를 회피하기 위하여 필요한 경우에는 해당 직무를 다른 사람으로 하여금 처리하게 하는 등의 조치를 하여야 한다.

⑤ 재산공개대상임기제공무원이 제3항 단서에 따라 본인 또는 그 이해관계자가 보유하고 있는 주식과 관련한 직무에 관여한 경우에는 분기별로 해당 주식과 관련한 직무에 직접적 또는 간접적으로 관여한 내용을 해당 분기가 끝나는 날부터 10일이 되는 날까지 우주항공청장에게 신고하여야 한다.

⑥ 우주항공청장은 제5항에 따라 신고받은 내용을 관보에 게재하여야 한다.

⑦ 우주항공청장은 재산공개대상임기제공무원이 제3항을 위반하여 해당 주식과 관련한 직무에 관여하였거나 제5항을 위반하여 신고를 하지 아니한 경우에는 「국가공무원법」 제81조에 따른 관할 징계위원회에 징계 의결을 요구하여야 한다.

⑧ 우주항공청장은 재산공개대상임기제공무원이 제3항의 금지의무 또는 제5항의 신고의무를 위반하여 수행한 직무가 위법한 것으로 확정된 경우에는 그 직무를 통하여 본인 또는 그 이해관계자가 얻은 재산상 이익을 환수하여야 한다.

⑨ 제5항에 따른 신고의 방법, 절차 등에 관하여 필요한 사항은 우주항공청장이 정한다.
