영해 및 접속수역법 제8조(벌칙)

① 제5조제2항 또는 제3항을 위반한 외국선박의 승무원이나 그 밖의 승선자는 5년 이하의 징역 또는 3억원 이하의 벌금에 처하고, 정상을 고려하여 필요할 때에는 해당 선박, 기재(器材), 채포물(採捕物) 또는 그 밖의 위반물품을 몰수할 수 있다. <개정 2018.3.13>

② 제6조에 따른 명령이나 조치를 거부ㆍ방해 또는 기피한 외국선박의 승무원이나 그 밖의 승선자는 2년 이하의 징역 또는 1억원 이하의 벌금에 처한다. <개정 2018.3.13>

③ 제1항 및 제2항의 경우 징역형과 벌금형은 병과(倂科)할 수 있다.

④ 이 조를 적용할 때 그 행위가 이 법 외의 다른 법률에 규정된 죄에 해당하는 경우에는 그 중 가장 무거운 형으로 처벌한다.
