영재교육 진흥법 제16조(특례자 선정 등)

① 특례자로 선정되고자 하는 사람 또는 그의 보호자는 거주지의 교육감에게 특례자 선정을 신청하여야 한다.

② 제1항에 따라 신청을 받은 교육감은 이 법에서 정한 영재교육연구원에 판별ㆍ심사를 의뢰하여야 하며, 영재교육연구원의 심사 결과에 따라 특례자를 선정하여 이를 당사자에게 통보하여야 한다.

(2) The^ð더 superintendent수퍼^r런텐던트 of어^v브 education에저케이션 who후 has해즈 received^r러시^v브드 an앤 application애플러케이션 under언더 paragraph패^r러그^r래^f프 (1) shall섈 request^r리퀘스트 identification아이덴터^f퍼케이션 and앤드 review^r리^v뷰 by바이 a어 research^r리서치 institute인스터툿 for^f포 education에저케이션 for^f포 the^ð더 gifted기^f프티드 prescribed프^r리스크^r라이브드 in인 this^ð디스 Act,액트 and앤드 shall섈 select설렉트 the^ð더 special-case스페실-케이스 person퍼슨 according어코딩 to투 the^ð더 results^r리절츠 of어^v브 the^ð더 review^r리^v뷰 by바이 the^ð더 research^r리서치 institute인스터툿 and앤드 notify노우터^f파이 the^ð더 person퍼슨 concerned.컨선드

③ 특례자로 선정된 사람에 대하여는 해당 학생의 재능과 잠재력이 충분히 발휘될 수 있도록 필요한 범위에서 「초ㆍ중등교육법」 제13조, 제24조부터 제27조까지, 제39조, 제42조, 제43조, 제46조 및 제47조에도 불구하고 해당 조문을 달리 적용할 수 있다.

(3) With위^ð드 respect^r리스펙트 to투 a어 person퍼슨 selected설렉티드 as애즈 a어 special-case스페실-케이스 person,퍼슨 Articles아터클즈 13, 24 through^θ쓰^r루 27, 39, 42, 43, 46 and앤드 47 of어^v브 the^ð디 Elementary엘러멘트^r리 and앤드 Secondary세컨데^r리 Education에저케이션 Act액트 may메이 be비 applied어플라이드 differently,디^f프^r런틀리 to투 the^ð디 extent익스텐트 necessary,네서세^r리 notwithstanding낫위^ð드스탠딩 those^ð도우즈 provisions,프^r러^v비전즈 so소우 that^ð댓 the^ð더 student's스투던츠 talent탤런트 and앤드 potential퍼텐실 can캔 be비 fully^f풀리 exercised.엑서사이즈드

④ 특례자로 선정되어 상급학교에 조기입학한 사람은 입학에 필요한 자격을 갖춘 것으로 본다.

(4) A어 person퍼슨 selected설렉티드 as애즈 a어 special-case스페실-케이스 person퍼슨 who후 has해즈 entered엔터드 a어 higher-level하이어-레^v블 school스쿨 early얼리 is이즈 deemed딤드 to투 have해^v브 the^ð더 qualifications콸러^f퍼케이션즈 required^r리콰이어드 for^f포 admission.애드미션

⑤ 제1항부터 제4항까지의 규정에 따른 특례자에 관한 판별ㆍ심사의 기준 및 절차와 통보, 조기입학 자격 등 필요한 사항은 대통령령으로 정한다.
