연안관리법 제35조(토지등에의 출입 등)

① 연안정비사업시행자와 제5조에 따른 조사 및 제34조에 따른 점검을 하는 공무원은 연안정비사업 또는 연안의 조사 등을 위하여 필요한 경우에는 다음 각 호의 행위를 할 수 있다.

② 제1항에 따라 타인이 점용하는 토지등에 출입하려는 자는 출입하려는 날의 7일 전까지 토지등의 소유자ㆍ점유자 또는 관리인(이하 "소유자등"이라 한다)에게 출입 일시와 장소 등을 알려야 한다. 다만, 다음 각 호의 어느 하나에 해당하는 경우에는 해당 지역을 관할하는 읍ㆍ면 사무소 또는 동 주민센터의 게시판이나 인터넷 홈페이지 또는 일간신문에 출입하려는 날의 14일 전까지 출입 일시와 장소 등을 공고하여야 한다. <개정 2017.3.21>

③ 해 뜨기 전이나 해가 진 후에는 토지등의 소유자등의 승낙 없이 택지 또는 담장이나 울타리로 둘러싸인 타인의 토지등에 출입할 수 없다. <개정 2017.3.21>

④ 연안정비사업시행자 또는 조사 등을 실시하는 공무원은 제1항제2호 또는 제3호의 행위를 할 때에는 토지 또는 장애물의 소유자등의 동의를 받아야 한다. 다만, 다음 각 호의 어느 하나에 해당하는 경우로서 해당 행위의 일시, 장소 및 내용 등을 해당 지역을 관할하는 읍ㆍ면 사무소 또는 동 주민센터의 게시판이나 인터넷 홈페이지 또는 일간신문에 공고한 후 14일이 지난 경우에는 그러하지 아니하다. <개정 2017.3.21, 2020.2.18>

⑤ 토지의 소유자등은 정당한 사유 없이 제1항에 따른 출입, 일시 사용 및 장애물의 변경ㆍ제거 행위를 방해하거나 거부하지 못한다. <개정 2017.3.21>
