연구직 및 지도직공무원의 임용 등에 관한 규정 제26조(일반 승진시험의 요구)

① 임용권자나 임용제청권자가 연구관이나 지도관으로의 일반 승진시험을 요구할 때에는 그 기관의 시험요구일 현재 연구관이나 지도관으로의 승진후보자 명부에서 승진임용이 제한되거나 응시자격이 정지 중인 사람을 제외한 순위가 높은 사람부터 차례로 결원과 예상 결원을 합한 총결원의 2배수 이상 5배수 이하에 해당되는 인원에 대하여 인사혁신처장이 정한 기한까지 시험의 실시를 요구하여야 한다. <개정 2013.3.23, 2014.11.19>

② 제1항에 따른 총결원의 계산방법은 시험령 제42조제2항을 적용한다.

③ 법 제40조의4제1항 및 이 영 제22조제1항제1호부터 제3호까지의 규정에 따른 연구관이나 지도관으로의 일반 승진시험요구는 대상자별로 4번까지만 할 수 있다. 이 경우 제1항에도 불구하고 2배수 이상 5배수 이하에 해당되지 아니하는 인원에 대하여 시험을 요구할 수 있으며, 제22조제1항제1호 및 제2호의 사유로 일반승진시험을 요구할 때에는 해당자만을 대상으로 시험을 요구할 수 있다.

④ 연구관이나 지도관으로의 일반 승진시험에 5번 불합격한 연구사나 지도사는 최종시험 응시일부터 5년이 지난 후에 일반 승진시험에 응시할 수 있다. 이 경우 질병, 임신ㆍ출산이나 법령에 따른 의무수행 등 정당한 사유로 일반 승진시험에 응시하지 아니하여 불합격한 경우에는 불합격한 것으로 보지 아니한다.

⑤ 총결원에 대하여 일반 승진시험을 실시하는 경우에는 기관별ㆍ직류별 또는 직렬별로 1년에 한 차례 실시한다. 다만, 합격자가 총결원에 미달되거나 그 밖에 특별한 사유가 인정되는 경우에는 추가시험을 실시할 수 있다.
