어촌특화발전 지원 특별법 제25조(어촌특화시설의 목적 외 사용)

① 어촌특화시설관리자가 어촌특화시설을 본래 목적 외의 목적에 사용하려 하거나 타인에게 사용하게 할 때에는 시장ㆍ군수ㆍ구청장의 승인을 받아야 한다. 다만, 어촌특화시설관리자가 어촌특화시설의 유지ㆍ관리에 지장이 없는 범위에서 대통령령으로 정하는 경미한 사항인 경우에는 그러하지 아니하다.

② 제1항에 따른 목적 외의 사용은 그 본래의 목적 또는 사용에 방해가 되지 아니하는 범위에서 하여야 한다.

③ 어촌특화시설관리자는 어촌특화시설을 본래 목적 외의 목적에 사용하는 자로부터 어촌특화시설을 유지하거나 보수하는 데에 필요한 경비의 전부 또는 일부를 징수할 수 있다.

④ 제3항에 따라 목적 외의 사용에 따른 경비를 징수하는 경우에는 지방세 체납처분의 예에 따라 징수할 수 있다.

⑤ 목적 외의 사용에 관한 절차ㆍ기간 및 범위, 경비 징수 범위와 징수된 경비의 사용 범위, 그 밖에 필요한 사항은 대통령령으로 정한다.
