어촌ㆍ어항법 제55조(권리ㆍ의무의 이전)

① 이 법에 따른 승인ㆍ허가로 인하여 발생한 권리ㆍ의무를 가진 자가 사망하거나 그 권리ㆍ의무를 양도하거나 그 권리ㆍ의무를 가진 법인이 합병하였을 때에는 그 상속인이나 권리ㆍ의무를 양수한 자나 합병 후 존속하는 법인 또는 합병으로 설립되는 법인이 그 지위를 승계한다.

② 제1항에 따라 지위를 승계한 자는 해양수산부령으로 정하는 바에 따라 해양수산부장관 또는 지방자치단체의 장에게 신고하여야 한다. <개정 2013.3.23>

③ 해양수산부장관 또는 지방자치단체의 장은 제2항에 따른 신고를 받은 날부터 해양수산부령으로 정하는 기간 내에 신고수리 여부를 신고인에게 통지하여야 한다. <신설 2018.12.11>

④ 해양수산부장관 또는 지방자치단체의 장이 제3항에서 정한 기간 내에 신고수리 여부 또는 민원 처리 관련 법령에 따른 처리기간의 연장을 신고인에게 통지하지 아니하면 그 기간(민원 처리 관련 법령에 따라 처리기간이 연장 또는 재연장된 경우에는 해당 처리기간을 말한다)이 끝난 날의 다음 날에 신고를 수리한 것으로 본다. <신설 2018.12.11>
