어장관리법 제12조(어장의 관리의무)

① 어업면허, 어업허가 또는 양식업면허를 받은 자는 어장환경을 보전하고 개선하기 위하여 대통령령으로 정하는 바에 따라 어장의 퇴적물이나 어장에 버려진 폐기물을 수거ㆍ처리(이하 "어장청소"라 한다)하여야 한다. 다만, 「재난 및 안전관리 기본법」에 따른 재난으로 인한 폐기물 등에 대하여는 그러하지 아니하다. <개정 2013.8.13, 2019.8.27>

② 어장정화ㆍ정비를 실시한 어장은 그 사업을 실시한 것을 제1항 전단에 따라 어장청소한 것으로 본다.

③ 어업면허, 어업허가 또는 양식업면허를 받은 자는 어장청소에 관한 업무를 제17조에 따라 어장정화ㆍ정비업의 등록을 한 자에게 위탁하여 실시할 수 있다. <개정 2019.8.27>

④ 시장ㆍ군수ㆍ구청장은 어업면허, 어업허가 또는 양식업면허를 받은 자가 제1항을 위반하여 어장청소를 하지 아니하는 경우에는 대통령령으로 정하는 바에 따라 기간을 정하여 어장청소를 명할 수 있다. <신설 2022.12.27>
