양육비 이행확보 및 지원에 관한 법률 제3조(미성년 자녀에 대한 양육 책임)

① 부 또는 모는 혼인상태 및 양육여부와 관계없이 미성년 자녀가 건강하게 성장할 수 있도록 의식주, 교육 및 건강 등 모든 생활영역에서 최적의 성장환경을 조성하여야 한다. <개정 2018.3.27>

② 비양육부ㆍ모는 양육부ㆍ모와의 합의 또는 법원의 판결 등에 따라 정하여진 양육비를 양육비 채권자에게 성실히 지급하여야 한다. 다만, 비양육부ㆍ모가 부양능력이 없는 미성년자인 경우에는 그 비양육부ㆍ모의 부모가 지급하여야 한다.
