신용협동조합법 제99조(벌칙)
Credit Unions Act, Article 99 (Penalty Provisions)
① 조합 또는 중앙회의 임직원 또는 청산인이 다음 각 호의 어느 하나에 해당하는 행위를 한 경우에는 3년 이하의 징역 또는 3천만원 이하의 벌금에 처한다. 이 경우 징역형과 벌금형을 병과(倂科)할 수 있다.
(1) Where an officer or employee or a liquidator of a union or the Federation commits any of the following, he or she shall be punished by imprisonment with labor for up to three years or by a fine not exceeding 30 million won. In such cases, imprisonment with labor and a fine may be imposed concurrently:
1. 조합 또는 중앙회의 사업 목적 외의 용도로 자금을 사용하거나 재산을 처분 또는 이용하여 조합 또는 중앙회에 손해를 끼친 경우
1. Where he or she has used funds for purposes other than the business purposes of the union or the Federation, or disposed of or used property, thereby causing damage to the union or the Federation;
2. 제7조를 위반하여 설립인가를 받은 경우
2. Where he or she has obtained authorization of establishment in violation of Article 7.
② 조합 또는 중앙회의 임직원 또는 청산인이 다음 각 호의 어느 하나에 해당하는 행위를 한 경우에는 2년 이하의 징역 또는 2천만원 이하의 벌금에 처한다. <개정 2017.4.18, 2025.1.21>
(2) Where an officer or employee or a liquidator of a union or the Federation commits any of the following, he or she shall be punished by imprisonment with labor for up to two years or by a fine not exceeding 20 million won:
1. 등기를 거짓으로 한 경우
1. Where he or she has made a false registration;
2. 제42조를 위반하여 동일인에 대한 대출등의 한도를 초과한 경우
2. Where he or she has exceeded the limit on loans, etc. to the same person, in violation of Article 42;
3. 제30조의2제1항, 제49조제1항 또는 제59조제3항을 위반한 경우
3. Where he or she has violated Article 30-2 (1), 49 (1), or 59 (3);
4. 제47조제2항에 따라 금융위원회가 정하는 회계처리기준 또는 결산에 관한 기준을 위반하여 거짓으로 재무제표를 작성하여 총회의 승인을 받은 경우
4. Where he or she has prepared false financial statements in violation of the accounting standards or settlement standards determined by the Financial Services Commission under Article 47 (2) and obtained approval of the general meeting;
5. 제81조제3항 또는 제4항을 위반한 경우
5. Where he or she has violated Article 81 (3) or (4);
6. 제86조제1항에 따른 경영관리에 응하지 아니한 경우
6. Where he or she has failed to comply with management administration under Article 86 (1);
7. 제89조제2항을 위반하여 자료의 제출, 출석 또는 진술을 거부하거나 거짓으로 자료를 제출하거나 진술을 한 경우
7. Where he or she has refused to submit data, appear, or make a statement, or has submitted false data or made a false statement, in violation of Article 89 (2);

③ 제3조제2항, 제27조의2(제72조제8항에 따라 준용되는 경우를 포함한다) 또는 제93조를 위반한 자는 1년 이하의 징역 또는 1천만원 이하의 벌금에 처한다.
(3) A person who violates Article 3 (2), Article 27-2 (including cases applied mutatis mutandis under Article 72 (8)), or Article 93 shall be punished by imprisonment with labor for up to one year or by a fine not exceeding 10 million won.
