식물신품종 보호법 제104조(대가에 대한 불복의 소)

① 제69조제2항제2호의 대가에 대하여 결정을 받은 자가 그 대가에 대하여 불복할 때에는 법원에 소를 제기할 수 있다.

③ 제1항에 따른 소송에서는 품종보호권자ㆍ전용실시권자 또는 통상실시권자를 피고로 하여야 한다.
