시설물의 안전 및 유지관리에 관한 특별법 제38조(안전진단전문기관의 영업 양도 등)

① 안전진단전문기관이 영업의 양도나 합병을 하려는 경우에는 국토교통부령으로 정하는 바에 따라 시ㆍ도지사에게 신고하여야 한다.

② 시ㆍ도지사는 제1항에 따른 신고를 받은 경우 그 내용을 검토하여 이 법에 적합하면 신고를 수리하여야 한다. <신설 2020.10.20>

③ 영업의 양수인이나 합병으로 설립 또는 존속하는 법인은 제1항에 따른 신고가 수리됨으로써 안전진단전문기관으로서의 지위를 승계한다. <개정 2020.10.20>

④ 제3항에 따라 종전의 안전진단전문기관의 지위를 승계한 자는 국토교통부령으로 정하는 바에 따라 제36조제1항에 따른 종전의 안전진단전문기관의 실적을 승계한다. <개정 2020.10.20>

⑤ 안전진단전문기관의 영업을 상속받는 경우에 대해서는 제1항부터 제4항까지의 규정을 준용한다. 이 경우 피상속인이 사망한 날부터 신고가 수리된 날까지의 기간 동안은 피상속인의 안전진단전문기관 등록을 상속인의 안전진단전문기관 등록으로 본다. <개정 2020.10.20>
