수산업법 제45조(어업허가를 받은 자의 지위 승계)

① 제40조 및 제43조에 따라 어업허가를 받은 어선ㆍ어구 또는 시설물(이하 이 조에서 "어선등"이라 한다)을 그 어업허가를 받은 자로부터 상속받거나 매입(「민사집행법」에 따른 경매나 그 밖에 이에 준하는 절차에 따라 매입하는 경우를 포함한다) 또는 임차한 자(어업허가를 받은 자가 법인인 경우에는 합병ㆍ분할 후 존속하는 법인을 포함한다)는 그 어업허가를 받은 자의 지위를 승계한다(상속의 경우 상속인이 반대의 의사표시를 한 경우와 제27조제3항 또는 「양식산업발전법」 제41조제3항에 따라 어업허가를 받은 어선을 임차하여 관리선으로 사용하는 경우는 제외한다). 이 경우 종전에 어업허가를 받은 자의 지위는 그 효력을 잃는다.

② 제1항에 따라 어업허가를 받은 자의 지위를 승계한 자는 승계 받은 날부터 30일(상속의 경우에는 60일로 한다) 이내에 해당 허가를 처분한 행정관청에 승계 사실을 해양수산부령으로 정하는 절차에 따라 신고하여야 하며, 해양수산부령으로 정하는 어업허가를 받은 어선등의 기준 및 어업허가 신청자의 자격을 갖추지 아니한 자는 승계 받은 날부터 90일 이내에 그 기준과 자격을 갖추어야 한다.

③ 행정관청은 제2항에 따른 신고를 받은 경우 그 내용을 검토하여 이 법에 적합하면 신고를 수리하여야 한다.

(3) Upon어판 receiving^r러시^v빙 a어 report^r리포트 under언더 paragraph패^r러그^r래^f프 (2), the^ð디 administrative어드미너스트^r레이티^v브 authority어^θ쏘^r러티 shall섈 review^r리^v뷰 its잇츠 contents칸텐츠 and앤드 accept액셉트 the^ð더 report^r리포트 if이^f프 it잇 conforms컨^f폼즈 to투 this^ð디스 Act.액트

④ 제1항에 따라 어업허가를 받은 자의 지위를 승계한 자는 그 어업허가에 부과된 행정처분 또는 부담이나 조건 등도 함께 승계한 것으로 본다. 다만, 어업허가의 지위를 승계한 자가 그 처분이나 위반사실을 알지 못하였음을 증명하는 때에는 그러하지 아니하다.

(4) A어 person퍼슨 who후 has해즈 succeeded석시디드 to투 the^ð더 status스태터스 of어^v브 a어 person퍼슨 who후 obtained어브테인드 a어 fishing^f피슁 permit퍼밋 under언더 paragraph패^r러그^r래^f프 (1) shall섈 be비 deemed딤드 to투 have해^v브 also올소 succeeded석시디드 to투 the^ð디 administrative어드미너스트^r레이티^v브 dispositions,디스퍼지션즈 burdens버든즈 or오 conditions컨디션즈 imposed임포우즈드 on안 the^ð더 fishing^f피슁 permit:퍼밋 Provided,프^r러^v바이디드 That^ð댓 this^ð디스 shall섈 not낫 apply어플라이 where웨어 the^ð더 person퍼슨 who후 succeeded석시디드 to투 the^ð더 status스태터스 proves프^r루^v브즈 that^ð댓 he히 or오 she쉬 was워즈 not낫 aware어웨어 of어^v브 the^ð더 disposition디스퍼지션 or오 violation.^v바이얼레이션

⑤ 행정관청은 제2항에 따른 신고를 받았을 때에는 「전자정부법」에 따라 「가족관계의 등록 등에 관한 법률」 제11조제4항의 전산정보자료를 공동이용(「개인정보 보호법」 제2조제2호에 따른 처리를 포함한다)할 수 있다.
