수산업ㆍ어촌 발전 기본법 제47조(기금의 조성)
Framework Act on the Fishing Industry and Fishing Villages Development, Article 47 (Raising the Fund)
① 기금은 다음 각 호의 재원으로 조성한다. <개정 2017.3.21, 2022.10.18>
(1) The Fund shall be raised from the following sources:
1. 정부출연금
1. Government contributions;
2. 다른 회계 또는 다른 기금으로부터의 전입금 및 예수금
2. Transfers and deposits from other accounts or funds;
3. 정부 외의 자의 출연금 또는 기부금
3. Contributions or donations from persons other than the Government;
4. 「공공자금관리기금법」에 따른 공공자금관리기금으로부터의 예수금
4. Deposits from the Public Capital Management Fund under the Public Capital Management Fund Act;
5. 「연근해어업의 구조개선 및 지원에 관한 법률」 제13조제1항제1호 및 제17조제1항제1호에 따른 어선, 어구, 어선의 장비 및 설비의 매각대금. 다만, 시ㆍ도지사가 매입한 경우에는 100분의 70을 초과하지 아니하는 범위에서 대통령령으로 정하는 금액으로 한다.
5. Proceeds from the sale of fishing vessels, fishing gear, and fishing vessel equipment and facilities under Article 13 (1) 1 and Article 17 (1) 1 of the Act on Structural Improvement and Support of Coastal and Offshore Fisheries: Provided, That where purchased by a Mayor/Do Governor, the amount shall be an amount prescribed by Presidential Decree within 70/100;
6. 「어촌ㆍ어항법」 제27조제1항에 따른 토지매각대금 중 국가어항의 토지매각대금
6. Among proceeds from the sale of land under Article 27 (1) of the Fishing Villages and Fishing Ports Act, proceeds from the sale of land in national fishing ports;
7. 「해양환경관리법」 제19조 및 제20조에 따른 해양환경개선부담금 및 가산금
7. Marine environment improvement charges and additional charges under Articles 19 and 20 of the Marine Environment Management Act;
8. 「공유수면 관리 및 매립에 관한 법률」 제13조제2항에 따른 해양수산부장관 소관의 점용료 및 사용료 중 「배타적 경제수역 및 대륙붕에 관한 법률」 제2조에 따른 배타적 경제수역에서의 토석ㆍ모래ㆍ자갈의 채취 또는 「광업법」에 따른 광물채취를 위한 점용료 및 사용료
8. Among occupancy and usage fees under the jurisdiction of the Minister of Oceans and Fisheries under Article 13 (2) of the Public Waters Management and Reclamation Act, occupancy and usage fees for collection of earth, stone, sand, and gravel in the exclusive economic zone under Article 2 of the Act on the Exclusive Economic Zone and the Continental Shelf, or for mineral collection under the Mining Industry Act;
9. 「해양생태계의 보전 및 관리에 관한 법률」 제49조 및 제51조에 따른 해양생태계보전부담금 및 가산금
9. Marine ecosystem conservation charges and additional charges under Articles 49 and 51 of the Act on the Conservation and Management of Marine Ecosystems;
10. 「자유무역협정 체결에 따른 농어업인 등의 지원에 관한 특별법」 제22조제1항에 따라 해양수산부장관이 납부하게 하거나 부과하는 공매납입금 또는 수입이익금
10. Public sale payments or import profits that the Minister of Oceans and Fisheries causes to be paid or imposes under Article 22 (1) of the Special Act on Support for Farmers and Fishers, etc. Following Conclusion of Free Trade Agreements;
11. 「해양심층수의 개발 및 관리에 관한 법률」 제40조에 따른 해양심층수이용부담금
11. Deep ocean water use charges under Article 40 of the Act on Development and Management of Deep Ocean Water;
12. 제2항에 따른 차입금 또는 차관
12. Borrowings or foreign loans under paragraph (2);
13. 기금운용 수익금 등
13. Fund management income, etc.;
14. 「수산물 유통의 관리 및 지원에 관한 법률」 제40조제3항에 따라 납입되는 금액
14. Amounts paid under Article 40 (3) of the Act on Management and Support of Fishery Product Distribution;
15. 「수산물 유통의 관리 및 지원에 관한 법률」 제41조제5항에 따라 납입되는 금액
15. Amounts paid under Article 41 (5) of the Act on Management and Support of Fishery Product Distribution; and
16. 「수산물 유통의 관리 및 지원에 관한 법률」 제45조제2항에 따라 납입되는 금액
16. Amounts paid under Article 45 (2) of the Act on Management and Support of Fishery Product Distribution.
② 정부는 국내에서 기금을 차입하거나 차관을 도입하여 그 자금을 기금에 대여할 수 있다.
(2) The Government may borrow funds for the Fund domestically or introduce foreign loans and lend the funds to the Fund.
