수도권정비계획법 제12조(과밀부담금의 부과ㆍ징수)

① 과밀억제권역에 속하는 지역으로서 대통령령으로 정하는 지역에서 인구집중유발시설 중 업무용 건축물, 판매용 건축물, 공공 청사, 그 밖에 대통령령으로 정하는 건축물을 건축(신축ㆍ증축 및 공공 청사가 아닌 시설을 공공 청사로 하는 용도변경, 그 밖에 대통령령으로 정하는 용도변경을 말한다. 이하 같다)하려는 자는 과밀부담금(이하 "부담금"이라 한다)을 내야 한다.

② 부담금을 내야 할 자가 대통령령으로 정하는 조합인 경우 그 조합이 해산하면 그 조합원이 부담금을 내야 한다.

③ 부담금 납부 의무의 승계, 연대(連帶) 납부 의무와 제2차 납부 의무에 관하여는 「국세기본법」 제23조부터 제25조까지 및 같은 법 제38조부터 제41조까지의 규정을 준용한다.
