Act on the Protection of and Support for Small Business Owners, Article 16-3 (Revocation of Designation of Centenary Small Business Owners)

① 중소벤처기업부장관은 제16조의2에 따라 지정된 백년소상공인이 다음 각 호의 어느 하나에 해당하면 그 지정을 취소할 수 있다. 다만, 제1호의 경우에는 그 지정을 취소하여야 한다. <개정 2025.12.2>

1. 거짓이나 그 밖의 부정한 방법으로 지정을 받은 경우

4. 제16조의2제2항에 따른 유효기간 내에 「농수산물의 원산지 표시 등에 관한 법률」, 「식품위생법」, 「식품 등의 표시ㆍ광고에 관한 법률」 등 관련 법률을 위반하여 영업정지처분, 영업취소처분, 과징금 부과처분 등 영업 관련 행정제재처분을 받은 경우. 다만, 이의신청 등 불복절차가 진행 중인 경우는 제외한다.

② 중소벤처기업부장관은 제1항에 따라 백년소상공인의 지정을 취소하려면 청문을 실시하여야 한다.

③ 중소벤처기업부장관은 제1항에 따라 백년소상공인의 지정을 취소한 경우에는 그 사실을 지체 없이 관계 중앙행정기관의 장 및 관할 지방자치단체의 장에게 통보하여야 한다.
