소방시설 설치 및 관리에 관한 법률 제50조(권한 또는 업무의 위임ㆍ위탁 등)

① 이 법에 따른 소방청장 또는 시ㆍ도지사의 권한은 대통령령으로 정하는 바에 따라 그 일부를 소속 기관의 장, 시ㆍ도지사, 소방본부장 또는 소방서장에게 위임할 수 있다.

② 소방청장은 다음 각 호의 업무를 「소방산업의 진흥에 관한 법률」 제14조에 따른 한국소방산업기술원(이하 "기술원"이라 한다)에 위탁할 수 있다. 이 경우 소방청장은 기술원에 소방시설 및 소방용품에 관한 기술개발ㆍ연구 등에 필요한 경비의 일부를 보조할 수 있다.

③ 소방청장은 제37조제3항 및 제40조제2항에 따른 제품검사 업무를 기술원 또는 전문기관에 위탁할 수 있다.

④ 제2항 및 제3항에 따라 위탁받은 업무를 수행하는 기술원 및 전문기관이 갖추어야 하는 시설기준 등에 관하여 필요한 사항은 행정안전부령으로 정한다.

⑤ 소방청장은 다음 각 호의 업무를 대통령령으로 정하는 바에 따라 소방기술과 관련된 법인 또는 단체에 위탁할 수 있다.

⑥ 소방청장은 제14조제3항에 따른 건축 환경 및 화재위험특성 변화 추세 연구에 관한 업무를 대통령령으로 정하는 바에 따라 화재안전 관련 전문연구기관에 위탁할 수 있다. 이 경우 소방청장은 연구에 필요한 경비를 지원할 수 있다.

⑦ 제2항부터 제6항까지의 규정에 따라 위탁받은 업무에 종사하고 있거나 종사하였던 사람은 업무를 수행하면서 알게 된 비밀을 이 법에서 정한 목적 외의 용도로 사용하거나 다른 사람 또는 기관에 제공하거나 누설하여서는 아니 된다.
