선박소유자 등의 책임제한절차에 관한 법률 제15조(공탁보증인에 대한 공탁 이행강제)

① 공탁보증인이 제14조에 따른 법원의 공탁명령을 이행하지 아니한 경우 법원은 제20조에 따라 선임된 관리인의 신청에 의하여 공탁보증인에 대하여 공탁보증인이 법원의 공탁지정일에 공탁하였어야 할 금전과 그 중 책임한도액에 대하여 공탁지정일부터 완제일(完濟日)까지 「소송촉진 등에 관한 특례법」 제3조제1항에 따른 이율로 산정한 이자를 더한 금전을 관리인에게 지급할 것을 명하여야 한다.

② 제1항에 따른 결정은 관리인 및 공탁보증인에게 송달하여야 한다.

(2) The^ð더 decision디시전 under언더 paragraph패^r러그^r래^f프 (1) shall섈 be비 served서^v브드 on안 the^ð디 administrator어드미너스트^r레이터 and앤드 the^ð더 deposit더파짓 guarantor.게^r런토

③ 제1항에 따른 결정은 집행력 있는 채무명의와 동일한 효력이 있다.

④ 제1항의 신청에 대한 재판에 대하여는 즉시항고를 할 수 있다.

⑤ 관리인이 제1항의 명령에 따라 공탁보증인으로부터 금전을 지급받았을 때에는 즉시 이를 공탁하고 그 결과를 법원에 보고하여야 한다. 이 경우에는 제12조를 준용한다.

⑥ 제5항에 따른 관리인의 공탁은 신청인이 공탁자로서 한 공탁으로 본다.
