Act on the Conservation and Use of Biological Diversity, Article 2 (Definitions)
이 법에서 사용하는 용어의 뜻은 다음과 같다. <개정 2018.10.16, 2019.12.10, 2025.10.1>
The meanings of the terms used in this Act are as follows:
1. "생물다양성"이란 육상생태계 및 수생생태계와 이들의 복합생태계를 포함하는 모든 원천에서 발생한 생물체의 다양성을 말하며, 종내(種內)ㆍ종간(種間) 및 생태계의 다양성을 포함한다.
1. "Biological diversity" means the diversity of living organisms from all sources, including terrestrial ecosystems, aquatic ecosystems and ecological complexes of which they are part, and includes diversity within species, between species and of ecosystems.
2. "생태계"란 식물ㆍ동물 및 미생물 군집(群集)들과 무생물 환경이 기능적인 단위로 상호작용하는 역동적인 복합체를 말한다.
2. "Ecosystem" means a dynamic complex of plant, animal and microorganism communities and their non-living environment interacting as a functional unit.
3. "생물자원"이란 사람을 위하여 가치가 있거나 실제적 또는 잠재적 용도가 있는 유전자원, 생물체, 생물체의 부분, 개체군 또는 생물의 구성요소를 말한다.
3. "Biological resources" means genetic resources, organisms or parts thereof, populations, or any other biotic components of ecosystems with actual or potential use or value for humanity.
4. "유전자원"이란 유전(遺傳)의 기능적 단위를 포함하는 식물ㆍ동물ㆍ미생물 또는 그 밖에 유전적 기원이 되는 유전물질 중 실질적 또는 잠재적 가치를 지닌 물질을 말한다.
4. "Genetic resources" means plants, animals, microorganisms or other genetic material of genetic origin that contain functional units of heredity and have actual or potential value.
5. "지속가능한 이용"이란 현재 세대와 미래 세대가 동등한 기회를 가지고 생물자원을 이용하여 그 혜택을 누릴 수 있도록 생물다양성의 감소를 유발하지 아니하는 방식과 속도로 생물다양성의 구성요소를 이용하는 것을 말한다.
5. "Sustainable use" means the use of components of biological diversity in a manner and at a rate that does not lead to the long-term decline of biological diversity, so that present and future generations can use biological resources with equal opportunity and enjoy their benefits.
6. "전통지식"이란 생물다양성의 보전 및 생물자원의 지속가능한 이용에 적합한 전통적 생활양식을 유지하여 온 개인 또는 지역사회의 지식, 기술 및 관행(慣行) 등을 말한다.
6. "Traditional knowledge" means the knowledge, skills and practices of individuals or local communities that have maintained traditional lifestyles suitable for the conservation of biological diversity and sustainable use of biological resources.
6의2. "유입주의 생물"이란 국내에 유입(流入)될 경우 생태계에 위해(危害)를 미칠 우려가 있는 생물로서 기후에너지환경부장관이 지정ㆍ고시하는 것을 말한다.
6-2. "Organisms requiring caution on introduction" means organisms that may harm ecosystems if introduced into the Republic of Korea and that are designated and publicly notified by the Minister of Climate, Energy and Environment.
7. "외래생물"이란 외국으로부터 인위적 또는 자연적으로 유입되어 그 본래의 원산지 또는 서식지를 벗어나 존재하게 된 생물을 말한다.
7. "Alien species" means organisms that have been introduced from abroad, artificially or naturally, and exist outside their original place of origin or habitat.
8. "생태계교란 생물"이란 다음 각 목의 어느 하나에 해당하는 생물로서 제21조의2제1항에 따른 위해성평가 결과 생태계 등에 미치는 위해가 큰 것으로 판단되어 기후에너지환경부장관이 지정ㆍ고시하는 것을 말한다.
8. "Ecosystem-disturbing species" means organisms falling under any of the following that are designated and publicly notified by the Minister of Climate, Energy and Environment as having been determined to cause great harm to ecosystems, etc. as a result of a risk assessment under Article 21-2 (1):
가. 유입주의 생물 및 외래생물 중 생태계의 균형을 교란하거나 교란할 우려가 있는 생물
(a) Among organisms requiring caution on introduction and alien species, organisms that disturb or are likely to disturb the balance of ecosystems;
나. 유입주의 생물이나 외래생물에 해당하지 아니하는 생물 중 특정 지역에서 생태계의 균형을 교란하거나 교란할 우려가 있는 생물
(b) Among organisms not falling under organisms requiring caution on introduction or alien species, organisms that disturb or are likely to disturb the balance of ecosystems in a specific region; and

8의2. "생태계위해우려 생물"이란 다음 각 목의 어느 하나에 해당하는 생물로서 제21조의2제1항에 따른 위해성평가 결과 생태계 등에 유출될 경우 위해를 미칠 우려가 있어 관리가 필요하다고 판단되어 기후에너지환경부장관이 지정ㆍ고시하는 것을 말한다.
8-2. "Ecosystem risk-concern species" means organisms falling under any of the following that are designated and publicly notified by the Minister of Climate, Energy and Environment as requiring management because they are likely to cause harm if released into ecosystems, etc., as determined by a risk assessment under Article 21-2 (1):
가. 「야생생물 보호 및 관리에 관한 법률」 제2조제2호에 따른 멸종위기 야생생물 등 특정 생물의 생존이나 「자연환경보전법」 제12조제1항에 따른 생태ㆍ경관보전지역 등 특정 지역의 생태계에 부정적 영향을 주거나 줄 우려가 있는 생물
(a) Organisms that have or are likely to have a negative effect on the survival of specific organisms such as endangered wildlife under Article 2, subparagraph 2 of the Act on the Protection and Management of Wildlife, or on the ecosystem of a specific area such as an ecosystem and landscape conservation area under Article 12 (1) of the Natural Environment Conservation Act; and
나. 제8호 각 목의 어느 하나에 해당하는 생물 중 산업용으로 사용 중인 생물로서 다른 생물 등으로 대체가 곤란한 생물
(b) Among organisms falling under any item of subparagraph 8, organisms in industrial use that are difficult to replace with other organisms, etc.
9. "외국인"이란 다음 각 목의 어느 하나에 해당하는 자를 말한다.
9. "Foreigner" means any of the following:
가. 대한민국 국적을 가지지 아니한 사람
(a) A person who does not have the nationality of the Republic of Korea; and
나. 외국의 법률에 따라 설립된 법인(외국에 본점 또는 주된 사무소를 가진 법인으로서 대한민국의 법률에 따라 설립된 법인을 포함한다)
(b) A juristic person established under the laws of a foreign country (including a juristic person that has its head office or principal office in a foreign country and is established under the laws of the Republic of Korea).
10. "생태계서비스"란 인간이 생태계로부터 얻는 다음 각 목의 어느 하나에 해당하는 혜택을 말한다.
10. "Ecosystem services" means any of the following benefits that humans obtain from ecosystems:
가. 식량, 수자원, 목재 등 유형적 생산물을 제공하는 공급서비스
(a) Provisioning services that supply tangible products such as food, water resources and timber;
나. 대기 정화, 탄소 흡수, 기후 조절, 재해 방지 등의 환경조절서비스
(b) Regulating services such as air purification, carbon absorption, climate regulation and disaster prevention;
다. 생태 관광, 아름답고 쾌적한 경관, 휴양 등의 문화서비스
(c) Cultural services such as ecotourism, beautiful and pleasant landscapes and recreation; and
라. 토양 형성, 서식지 제공, 물질 순환 등 자연을 유지하는 지지서비스
(d) Supporting services that sustain nature, such as soil formation, habitat provision and nutrient cycling.
