새마을금고법 시행령 제10조의4(선거관리위원회의 구성ㆍ운영ㆍ직무 등)

① 법 제23조제1항에 따른 선거관리위원회(이하 "선거관리위원회"라 한다)의 설치기간은 임원 선거 공고일(법 제23조의2에 따라 선거관리를 위탁하는 경우에는 「공공단체등 위탁선거에 관한 법률」 제24조의2에 따른 예비후보자등록신청개시일을 말한다) 전날부터 선거일 후 2개월이 되는 날까지로 한다. <개정 2025.6.25>

② 다음 각 호의 어느 하나에 해당하는 사람은 선거관리위원회의 위원이 될 수 없다.

(2) A어 person퍼슨 falling^f팔링 under언더 any에니 of어^v브 the^ð더 following^f팔로잉 may메이 not낫 become비컴 a어 member멤버 of어^v브 the^ð디 election일렉션 commission:커미션

③ 법 제23조제2항에 따라 금고의 회원이 아닌 사람으로서 선거관리위원회의 위원이 될 수 있는 사람은 다음 각 호의 어느 하나에 해당하는 사람으로 한다.

④ 선거관리위원회의 위원장(이하 "선거관리위원장"이라 한다)은 위원 중에서 호선하고, 선거관리위원회를 대표하며, 선거관리위원회의 의장이 된다.

(4) The^ð더 chairperson체어퍼슨 of어^v브 the^ð디 election일렉션 commission커미션 (hereinafter히^r리내^f프터 referred^r러^f퍼드 to투 as애즈 the^ð디 "election일렉션 commission커미션 chairperson")체어퍼슨 shall섈 be비 elected일렉티드 by바이 the^ð더 members멤버즈 from^f프^r럼 among어멍 themselves,^ð뎀셀^v브즈 represent^r레프^r리젠트 the^ð디 election일렉션 commission,커미션 and앤드 serve서^v브 as애즈 the^ð더 presiding프^r리자이딩 officer오^f퍼서 of어^v브 the^ð디 election일렉션 commission.커미션

⑤ 선거관리위원장이 부득이한 사유로 직무를 수행할 수 없을 때에는 위원 중에서 호선하여 위원장의 직무를 대행하게 한다.

⑥ 선거관리위원회는 후보자의 자격심사, 선거인명부의 확정, 그 밖에 정관으로 정하는 사무를 관장한다.

(6) The^ð디 election일렉션 commission커미션 shall섈 take테이크 charge차지 of어^v브 the^ð더 qualification콸러^f퍼케이션 screening스크^r리닝 of어^v브 candidates,캔더데잇츠 the^ð더 finalization^f파이널리제이션 of어^v브 the^ð더 voter^v보우터 list,리스트 and앤드 other어^ð더 affairs어^f페어즈 determined디터먼드 by바이 the^ð디 articles아터클즈 of어^v브 incorporation.인코퍼^r레이션

⑦ 선거관리위원회는 위원 과반수의 출석으로 개의하고, 출석위원 과반수의 찬성으로 의결한다.

(7) The^ð디 election일렉션 commission커미션 shall섈 be비 opened오우픈드 with위^ð드 the^ð디 attendance어텐든스 of어^v브 a어 majority머조^r러티 of어^v브 its잇츠 members멤버즈 and앤드 shall섈 adopt어답트 resolutions^r레절루션즈 with위^ð드 the^ð더 concurrence컨커^r런스 of어^v브 a어 majority머조^r러티 of어^v브 the^ð더 members멤버즈 present.프^r레전트

⑧ 제1항부터 제7항까지에서 규정한 사항 외에 선거관리위원회의 구성ㆍ운영ㆍ직무 등에 필요한 사항은 정관으로 정한다.
