상표법 제83조(상표권의 존속기간)
Trademark Act, Article 83 (Term of Trademark Rights)
① 상표권의 존속기간은 제82조제1항에 따라 설정등록이 있는 날부터 10년으로 한다.
(1) The term of a trademark right shall be 10 years from the date of establishment registration under Article 82 (1).
② 상표권의 존속기간은 존속기간갱신등록신청에 의하여 10년씩 갱신할 수 있다.
(2) The term of a trademark right may be renewed for successive periods of 10 years upon a request for renewal registration.
③ 제1항 및 제2항에도 불구하고 다음 각 호의 어느 하나에 해당하는 경우에는 상표권의 설정등록일 또는 존속기간갱신등록일부터 5년이 지나면 상표권이 소멸한다.
(3) Notwithstanding paragraphs (1) and (2), in any of the following cases, the trademark right shall be extinguished when five years have passed from the date of establishment registration or renewal registration of the trademark right:
1. 제72조제3항 또는 제74조에 따른 납부기간 내에 상표등록료(제72조제1항 각 호 외의 부분 후단에 따라 상표등록료를 분할납부하는 경우로서 2회차 상표등록료를 말한다. 이하 이 항에서 같다)를 내지 아니한 경우
1. Where the trademark registration fees (meaning the second installment, where the fees are paid in installments under the latter part of Article 72 (1), other than the subparagraphs; hereinafter the same shall apply in this paragraph) are not paid within the payment period under Article 72 (3) or 74;
2. 제76조제1항에 따라 상표등록료의 보전을 명한 경우로서 그 보전기간 내에 보전하지 아니한 경우
2. Where a person ordered to make up the trademark registration fees under Article 76 (1) does not make them up within the period for making up;
3. 제77조제1항에 해당하는 경우로서 그 해당 기간 내에 상표등록료를 내지 아니하거나 보전하지 아니한 경우
3. Where, in a case falling under Article 77 (1), the trademark registration fees are not paid or made up within the relevant period.
