산지관리법 제9조(산지전용ㆍ일시사용제한지역의 지정)

① 산림청장은 다음 각 호의 어느 하나에 해당하는 산지로서 공공의 이익증진을 위하여 보전이 특히 필요하다고 인정되는 산지를 산지전용 또는 산지일시사용이 제한되는 지역(이하 "산지전용ㆍ일시사용제한지역"이라 한다)으로 지정할 수 있다. <개정 2018.3.20>

② 산림청장은 제1항에 따라 산지전용ㆍ일시사용제한지역을 지정하려면 대통령령으로 정하는 바에 따라 해당 산지소유자, 지역주민 및 지방자치단체의 장의 의견을 듣고 관계 행정기관의 장과 협의한 후 중앙산지관리위원회의 심의를 거쳐야 한다. <개정 2012.2.22, 2016.12.2>

③ 산림청장은 제1항에 따라 산지전용ㆍ일시사용제한지역을 지정한 경우에는 대통령령으로 정하는 바에 따라 그 지정사실을 고시하고 관계 행정기관의 장에게 통보하여야 하며, 그 지정에 관한 관계 서류를 일반에게 공람하여야 한다. <개정 2012.2.22>

④ 산림청장은 제3항에도 불구하고 시장ㆍ군수ㆍ구청장으로 하여금 산지전용ㆍ일시사용제한지역의 지정에 관한 관계 서류를 일반에게 공람하게 할 수 있다. <신설 2012.2.22>
