산지관리법 제3조의2(산지관리기본계획의 수립 등)

① 산림청장은 산지를 합리적으로 보전하고 이용하기 위하여 「산림기본법」 제11조에 따른 산림기본계획(이하 "산림기본계획"이라 한다)에 따라 전국의 산지에 대한 산지관리기본계획(이하 "기본계획"이라 한다)을 10년마다 수립하여야 한다.

② 산림청장은 「국토기본법」에 따른 국토종합계획의 수정, 산지 현황의 현저한 변경 또는 그 밖에 필요하다고 인정하는 경우에는 기본계획을 변경할 수 있다.

③ 산림청장이 기본계획을 수립하거나 변경할 때에는 미리 관계 중앙행정기관의 장과 협의하고 특별시장ㆍ광역시장ㆍ특별자치시장ㆍ도지사 또는 특별자치도지사(이하 "시ㆍ도지사"라 한다)의 의견을 들은 후 제22조제1항에 따른 중앙산지관리위원회(이하 "중앙산지관리위원회"라 한다)의 심의를 거쳐야 한다. <개정 2012.2.22>

④ 산림청장은 기본계획에 따른 연도별 시행계획(이하 이 조에서 "시행계획"이라 한다)을 수립ㆍ시행하고 이에 필요한 재원을 확보하기 위하여 노력하여야 한다. <신설 2019.12.3>

⑤ 산림청장은 기본계획 및 시행계획을 수립하거나 변경한 때에는 지체 없이 국회 소관 상임위원회에 제출하여야 한다. <신설 2019.12.3>

⑥ 산림청장은 관계 중앙행정기관의 장과 지방자치단체의 장에게 기본계획의 수립 및 시행에 필요한 자료의 제출 또는 협조를 요청할 수 있다. 이 경우 관계 중앙행정기관의 장과 지방자치단체의 장은 특별한 사유가 없으면 그 요청을 따라야 한다. <개정 2019.12.3, 2020.5.26>

⑦ 산림청장이 기본계획을 수립하거나 변경하였을 때에는 대통령령으로 정하는 바에 따라 고시하고 관계 중앙행정기관의 장, 시ㆍ도지사 및 지방산림청장에게 통보하여야 하며, 시장(특별자치도 또는 특별자치시의 경우는 특별자치도지사 또는 특별자치시장을 말한다. 이하 같다)ㆍ군수ㆍ구청장(자치구의 구청장을 말한다. 이하 같다) 또는 지방산림청 국유림관리소장(이하 "국유림관리소장"이라 한다)으로 하여금 일반에게 공람하게 하여야 한다. <개정 2012.2.22, 2019.12.3>

⑧ 시ㆍ도지사 또는 지방산림청장은 제7항에 따라 산림청장으로부터 기본계획의 수립 또는 변경에 관한 통보를 받으면 기본계획의 내용을 반영하여 1년 이내에 관할 지역의 산지에 대한 산지관리지역계획(이하 "지역계획"이라 한다)을 수립하거나 변경하여야 한다. <개정 2019.12.3>

⑨ 시ㆍ도지사 또는 시장ㆍ군수ㆍ구청장이 다른 법률에 따른 환경ㆍ도시계획 등을 수립하려는 경우에는 제8항의 지역계획과 부합하도록 하여야 한다. <개정 2019.12.3>

⑩ 지역계획의 수립기간 및 수립절차 등에 관하여는 제1항, 제3항, 제6항 및 제7항을 준용한다. 이 경우 "시ㆍ도지사 및 지방산림청장"은 "시장ㆍ군수ㆍ구청장 및 국유림관리소장"으로, "중앙산지관리위원회"는 "제22조제2항에 따른 지방산지관리위원회(이하 "지방산지관리위원회"라 한다)"로 본다. <신설 2012.2.22, 2019.12.3>
