산지관리법 제19조(대체산림자원조성비)

① 다음 각 호의 어느 하나에 해당하는 자는 산지전용과 산지일시사용에 따른 대체산림자원 조성에 드는 비용(이하 "대체산림자원조성비"라 한다)을 미리 내야 한다. <개정 2010.5.31>

② 제1항에 따라 대체산림자원조성비를 내야 하는 자가 다음 각 호의 어느 하나에 해당하는 경우에는 제1항 각 호에 따른 산지전용허가, 산지일시사용허가 또는 행정처분을 받은 후에 대체산림자원조성비를 낼 수 있다. 다만, 제2호의 경우에는 제1항 각 호에 따른 산지전용허가, 산지일시사용허가 또는 행정처분을 받은 후 그 목적사업을 시작하기 전에 대체산림자원조성비의 100분의 50의 범위에서 농림축산식품부령으로 정하는 금액을 미리 내야 한다. <개정 2010.5.31, 2012.2.22, 2013.3.23, 2015.3.27, 2016.12.2, 2020.5.26>

③ 대체산림자원조성비는 산림청장등이 부과ㆍ징수하며, 그 징수금액은 「농어촌구조개선 특별회계법」에 따른 임업진흥사업계정의 세입으로 한다. 다만, 시ㆍ도지사 또는 시장ㆍ군수ㆍ구청장이 부과ㆍ징수하는 경우에는 그 징수금액의 10퍼센트를 해당 지방자치단체의 수입으로 한다. <개정 2012.2.22, 2014.3.11>

⑥ 산림청장등은 제5항에 따라 대체산림자원조성비를 감면(감면기간 연장을 포함한다)하려는 경우에는 감면의 타당성 등에 대하여 중앙산지관리위원회의 심의를 거쳐야 한다. <신설 2018.3.20>

⑧ 제1항에 따른 대체산림자원조성비는 산지전용 또는 산지일시사용되는 산지의 면적에 부과시점의 단위면적당 금액을 곱한 금액으로 하되, 단위면적당 금액은 산림청장이 결정ㆍ고시한다. 이 경우 산림청장은 제4조에 따라 구분된 산지별 또는 지역별로 단위면적당 금액을 달리할 수 있다. <개정 2010.5.31, 2016.12.2, 2018.3.20>

⑨ 대체산림자원조성비(제2항 각 호 외의 부분 단서에 따라 미리 내는 대체산림자원조성비는 제외한다)를 내야 하는 자가 납부기한까지 내지 아니하면 국세 체납처분의 예 또는 「지방행정제재ㆍ부과금의 징수 등에 관한 법률」에 따라 징수할 수 있다. <개정 2010.5.31, 2012.2.22, 2013.8.6, 2018.3.20, 2020.3.24>

⑩ 대체산림자원조성비의 납부 기한, 대체산림자원조성비의 단위면적당 금액의 세부 산정기준(「부동산 가격공시에 관한 법률」에 따른 해당 산지의 개별공시지가를 일부 포함한다) 등에 관한 사항은 대통령령으로 정한다. <개정 2010.5.31, 2012.2.22, 2016.1.19, 2017.4.18, 2018.3.20>

⑪ 대체산림자원조성비는 현금 또는 대통령령으로 정하는 납부대행기관을 통하여 신용카드ㆍ직불카드 등(이하 "신용카드등"이라 한다)으로 납부할 수 있다. 신용카드로 대체산림자원조성비를 납부하는 경우에는 대체산림자원조성비 납부대행기관의 승인일을 납부일로 본다. <신설 2017.4.18, 2018.3.20>
