산지관리법 제18조의2(산지전용타당성조사 등)

① 대통령령으로 정하는 규모 이상으로 제8조제1항에 따른 협의ㆍ변경협의를 신청하거나 제14조 또는 제15조의2에 따른 산지전용허가ㆍ변경허가 또는 산지일시사용허가ㆍ변경허가(다른 법률에 따라 산지전용허가ㆍ변경허가 또는 산지일시사용허가ㆍ변경허가가 의제되는 행정처분을 포함한다)를 받으려는 자는 미리 대통령령으로 정하는 산지전문기관으로부터 산지전용 또는 산지일시사용의 필요성ㆍ적합성ㆍ환경성 등을 종합적으로 고려한 타당성에 관한 조사(이하 "산지전용타당성조사"라 한다)를 받아야 한다. 다만, 산지전용 또는 산지일시사용을 하려는 용도가 농림어업용인 경우 등 대통령령으로 정하는 경우에는 그러하지 아니하다. <개정 2016.12.2>

② 제1항에 따른 산지전용타당성조사에 필요한 수수료는 산지전용타당성조사를 신청한 자가 산지전문기관에 납부하여야 한다.

③ 제1항에 따른 산지전용타당성조사의 신청을 받은 산지전문기관은 산지전용타당성조사를 실시한 후 그 결과를 산림청장등과 산지전용타당성조사를 신청한 자에게 통보하여야 한다. <개정 2012.2.22>

④ 산지전용타당성조사를 실시한 산지전문기관은 산지전용타당성조사와 관련하여 작성한 대통령령으로 정하는 서류 및 그 밖의 자료를 5년의 범위에서 대통령령으로 정하는 기간 동안 보관하여야 한다. <신설 2016.12.2, 2026.9.22>

⑤ 제1항부터 제4항까지에 따른 산지전용타당성조사의 절차ㆍ기준ㆍ방법 등과 수수료의 산정 및 산지전문기관의 감독 등에 관한 사항은 대통령령으로 정한다. <개정 2012.2.22, 2016.12.2>
