산업입지 및 개발에 관한 법률 제39조의12(재생사업 활성화구역의 지정)

① 재생사업지구지정권자는 재생사업의 효율적인 추진과 복합적인 토지이용을 촉진하기 위하여 재생사업 활성화구역(이하 "활성화구역"이라 한다)을 지정할 수 있다. 이 경우 활성화구역은 해당 재생사업지구 전체면적의 100분의 30을 초과할 수 없다.

② 재생사업지구지정권자는 제1항에 따라 활성화구역을 지정하려면 재생사업 활성화계획(이하 "활성화계획"이라 한다)을 수립하여 관할 시장ㆍ군수ㆍ구청장의 의견을 듣고 관계 행정기관의 장과 협의한 후에 국토교통부장관의 승인을 받아야 한다. 활성화계획을 변경하려는 경우에도 또한 같다.

③ 활성화계획에는 다음 각 호의 사항이 포함되어야 한다.

④ 재생사업지구지정권자는 제1항 및 제2항에 따라 활성화구역을 지정ㆍ변경하거나 활성화계획을 수립ㆍ변경하였을 때에는 그 내용을 고시하여야 하며 고시 및 열람에 대해서는 제39조의7을 준용한다. 활성화계획이 승인ㆍ고시된 때에는 제39조의7에 따른 재생시행계획이 수립ㆍ변경된 것으로 본다.

⑤ 활성화구역에서 재생사업 시행을 위한 사업시행자 범위, 사업 시행방식 등 그 세부사항에 대하여는 대통령령으로 정하는 바에 따른다.
