산업입지 및 개발에 관한 법률 제33조(시설 부담)

① 실시계획승인권자는 사업시행자에게 도로, 공원, 녹지, 그 밖에 대통령령으로 정하는 공공시설을 설치하게 하거나 녹지를 보존하게 할 수 있다.

② 사업시행자는 제1항에 따라 설치하는 시설(대통령령으로 정하는 시설은 제외한다) 등의 비용에 충당하기 위하여 그 비용의 범위에서 제30조에 따른 존치시설물의 소유자에게 시설부담금을 내게 할 수 있다. <개정 2012.6.1, 2016.12.20>

③ 제2항에 따른 시설부담금은 시설부담금 단가[기반시설 표준시설비용(「국토의 계획 및 이용에 관한 법률」 제68조제3항에 따라 국토교통부장관이 고시한 것을 말한다)에 민간 개발사업자의 부담률(「국토의 계획 및 이용에 관한 법률」 제68조제5항을 준용한다), 용도별 가중치 등을 곱하여 산정한다]에 존치하는 부지 면적을 곱하여 산정한다. 이 경우 용도별 가중치 등 시설부담금 단가의 구체적인 산정방식은 대통령령으로 정한다. <개정 2018.6.12>

④ 대통령령으로 정하는 존치시설물의 소유자에 대해서는 제2항에 따른 시설부담금을 면제한다. <신설 2016.12.20, 2018.6.12>
