산업입지 및 개발에 관한 법률 제30조(기존 공장의 존치 등)

① 사업시행자는 산업단지에 있는 기존의 공장 또는 건축물이나 그 밖의 공작물을 이전 또는 철거하지 아니하여도 산업단지개발사업에 지장이 없다고 인정할 때에는 이를 존치하게 할 수 있다.

② 사업시행자는 산업단지와 연접하여 있는 기존의 개별입지 공장의 소유자가 산업단지 안에 포함되기를 원할 경우에는 해당 공장을 산업단지개발사업에 포함하여 개발할 수 있으며, 연접 여부에 대한 판단은 대통령령으로 정하는 바에 따른다. 이 경우 산업입지개발지침에 따라 산업단지에 적용되는 녹지ㆍ도로율 등에 대한 기준은 기존의 개별입지 공장지역에 대하여 적용하지 아니할 수 있다.
