산업기술혁신 촉진법 제38조(한국산업기술진흥원의 설립 등)

① 산업기술혁신을 촉진하기 위한 사업을 효율적이고 체계적으로 추진하고 산업기술혁신 관련 정책의 개발을 지원하기 위하여 한국산업기술진흥원(이하 "기술진흥원"이라 한다)을 설립한다.

(1) The^ð더 Korea코^r리아 Institute인스터툿 for^f포 Advancement어드^v밴스먼트 of어^v브 Technology텍날러지 (hereinafter히^r리내^f프터 referred^r러^f퍼드 to투 as애즈 the^ð더 "Technology텍날러지 Promotion프^r러모우션 Institute")인스터툿 is이즈 established이스태블리시트 to투 efficiently이^f피션틀리 and앤드 systematically시스터매티클리 carry캐^r리 out아웃 projects프^r라젝츠 to투 promote프^r러모우트 industrial인더스트^r리얼 technology텍날러지 innovation이너^v베이션 and앤드 to투 support서포트 the^ð더 development디^v벨럽먼트 of어^v브 policies팔러시즈 related^r릴레이티드 to투 industrial인더스트^r리얼 technology텍날러지 innovation.이너^v베이션

② 기술진흥원은 법인으로 하고, 주된 사무소의 소재지에서 설립등기를 함으로써 성립한다.

(2) The^ð더 Technology텍날러지 Promotion프^r러모우션 Institute인스터툿 shall섈 be비 a어 corporation코퍼^r레이션 and앤드 shall섈 be비 established이스태블리시트 upon어판 registration^r레지스트^r레이션 of어^v브 its잇츠 establishment이스태블리시먼트 at앳 the^ð더 location로케이션 of어^v브 its잇츠 principal프^r린서플 office.오^f피스

③ 기술진흥원은 다음 각 호의 사업을 수행한다. <개정 2013.3.23, 2013.8.6, 2025.10.1>

(3) The^ð더 Technology텍날러지 Promotion프^r러모우션 Institute인스터툿 shall섈 carry캐^r리 out아웃 the^ð더 following^f팔로잉 projects:프^r라젝츠

④ 기술진흥원은 제3항 각 호의 사업에 대한 지원을 위하여 대통령령으로 정하는 부설기관을 설치할 수 있고, 지역기술혁신을 지원하기 위하여 지역사무소를 설치할 수 있다.

(4) The^ð더 Technology텍날러지 Promotion프^r러모우션 Institute인스터툿 may메이 establish이스태블리시 affiliated어^f필리에이티드 institutions인스티투션즈 prescribed프^r리스크^r라이브드 by바이 Presidential프^r레저덴실 Decree디크^r리 to투 support서포트 the^ð더 projects프^r라젝츠 under언더 each이치 subparagraph서브패^r러그^r래^f프 of어^v브 paragraph패^r러그^r래^f프 (3), and앤드 may메이 establish이스태블리시 regional^r리저늘 offices오^f퍼시즈 to투 support서포트 regional^r리저늘 technology텍날러지 innovation.이너^v베이션

⑤ 기술진흥원은 제1항에 따른 목적달성에 필요한 경비를 조달하기 위하여 대통령령으로 정하는 바에 따라 수익사업을 할 수 있다.

(5) The^ð더 Technology텍날러지 Promotion프^r러모우션 Institute인스터툿 may메이 engage엔게이지 in인 profit-making프^r라^f핏-메이킹 business,비즈니스 as애즈 prescribed프^r리스크^r라이브드 by바이 Presidential프^r레저덴실 Decree,디크^r리 to투 raise^r레이즈 the^ð디 expenses익스펜시즈 necessary네서세^r리 to투 achieve어치^v브 the^ð더 purpose퍼퍼스 under언더 paragraph패^r러그^r래^f프 (1).

⑥ 정부는 기술진흥원의 설립ㆍ운영에 필요한 경비를 예산의 범위에서 출연할 수 있으며, 중앙행정기관의 장 및 지방자치단체의 장은 제3항 각 호의 사업을 기술진흥원으로 하여금 수행하게 하고 그에 드는 비용의 전부 또는 일부를 출연할 수 있다.

⑦ 기술진흥원에 관하여 이 법에서 정한 것을 제외하고는 「민법」 중 재단법인에 관한 규정을 준용한다.
