사회기반시설에 대한 민간투자법 제35조(보증관계의 성립)

① 관리기관은 제34조에 따라 보증을 하는 경우에는 민간투자사업자금의 대출등을 받는 사업시행자등의 신용을 기금에 의하여 보증할 것을 내용으로 하는 계약을 대출기관등과 체결하여야 한다.

② 관리기관이 민간투자사업자금의 대출등을 받으려는 사업시행자등의 신청을 받아 이를 심사한 후 제1항에 따라 계약을 체결한 대출기관등에 통지하는 경우에는 관리기관과 해당 대출기관등 사이에 보증관계가 성립된 것으로 본다. 다만, 보증관계의 효력은 해당 대출기관등이 민간투자사업자금을 지급한 때부터 발생한 것으로 본다.

③ 제2항의 통지가 있은 날부터 60일 이내에 해당 대출기관등이 민간투자사업자금의 대출등을 신청한 사업시행자등에게 대출금 등을 지급하지 아니하거나 대출등의 승인을 신청인에게 통지하지 아니한 때에는 제2항에도 불구하고 해당 보증관계는 성립되지 아니한 것으로 본다.
