Private School Teachers and Staff Pension Act, Article 39-2 (Deductive Payment of Unpaid Amounts)

① 교직원 또는 교직원이었던 사람이 퇴직 또는 사망 시까지 다음 각 호의 미납금이나 그 밖에 공단에 대한 채무가 있을 때에는 퇴직급여ㆍ퇴직유족급여ㆍ재해유족급여 또는 퇴직수당의 금액에서 공제하여 지급한다. 다만, 학교기관의 장의 귀책사유로 미납된 경우에는 그러하지 아니하다. <개정 2013.5.22, 2018.3.20, 2018.4.17>

② 연금인 급여를 지급받으려는 사람이 제1항에 따른 채무(제1호는 제외한다)가 있을 때에는 연금인 급여 외의 퇴직급여ㆍ퇴직유족급여ㆍ재해유족급여 또는 퇴직수당에서 우선 공제하여 지급하고 남은 채무가 있을 때에는 해당 연금월액의 2분의 1 이상을 초과하여 공제하지 아니한다. <개정 2018.3.20, 2018.4.17>

③ 교직원 및 교직원이었던 사람이 급여청구 시 제1항의 미납금 및 채무액이 있는 경우에는 그 교직원이 소속되었던 학교경영기관의 장(학교에 근무하는 교직원인 경우에는 학교의 장)의 확인을 받아야 한다. <개정 2019.12.10>
