Private School Teachers and Staff Pension Act, Article 39 (Recovery of Benefits)
공단은 다음 각 호의 어느 하나에 해당하는 급여를 수급자(상속인을 포함한다)에게 지급한 경우에는 그 급여액을 환수하여야 한다. 이 경우, 제1호 또는 제2호의 경우에는 급여액에 대통령령으로 정하는 이자 및 환수비용을 가산하여 징수하고, 제3호 또는 제4호의 경우로서 환수금을 내야 할 사람이 기한 내에 내지 아니한 경우에는 대통령령으로 정하는 이자를 가산하여 징수한다.
Where the Service has paid to a recipient (including an heir) benefits falling under any of the following, it shall recover the benefit amount. In such cases, in the case of subparagraph 1 or 2, interest and recovery costs prescribed by Presidential Decree are added to the benefit amount and collected, and in the case of subparagraph 3 or 4, where the person who is to pay the recovered amount fails to pay by the deadline, interest prescribed by Presidential Decree is added and collected:
1. 거짓이나 그 밖의 부정한 방법으로 급여를 받은 경우
1. Where benefits were received by fraud or other improper means;
2. 이 법에 따라 각종 급여를 받을 권리를 가질 사람이 제34조제1항에 따라 급여를 신청하면서 공단에 급여제한사유에 대하여 사실과 달리 신고(신고하지 아니한 경우를 포함한다)하거나 급여지급 이후 발생한 급여제한사유 또는 수급권 상실사유를 공단에 사실과 달리 신고(신고하지 아니하거나 늦게 신고한 경우를 포함한다)하여 급여가 잘못 지급된 경우
2. Where benefits were paid erroneously because a person entitled to receive various benefits under this Act misreported (including failing to report) grounds for restriction of benefits to the Service when applying for benefits under Article 34 (1), or misreported (including failing to report or reporting late) to the Service grounds for restriction of benefits or grounds for loss of entitlement that arose after payment of benefits;
3. 급여를 받은 후 그 급여의 사유가 소급하여 소멸된 경우
3. Where the ground for benefits was retroactively extinguished after the benefits were received;
4. 그 밖에 급여가 잘못 지급된 경우
4. Where benefits were otherwise paid erroneously.
