빈집 및 소규모주택 정비에 관한 특례법 시행령 제10조(빈집의 철거보상비)

① 법 제11조제4항 전단에서 "대통령령으로 정하는 정당한 보상비"란 「감정평가 및 감정평가사에 관한 법률」에 따른 감정평가법인등(이하 "감정평가법인등"이라 한다) 2인 이상이 평가한 금액의 산술평균치를 말한다. <개정 2022.1.21>

② 빈집 소유자는 제9조제4항에 따라 직권 철거 결정을 알게 된 날부터 14일 이내에 시장ㆍ군수등에게 감정평가법인등 1인을 추천하여야 하며, 시장ㆍ군수등은 빈집 소유자가 추천하는 감정평가법인등 1인을 포함하여 제1항에 따른 감정평가법인등을 선정하여야 한다. 다만, 빈집 소유자의 소재를 알 수 없거나 빈집 소유자가 본문에 따른 기간 내에 감정평가법인등을 추천하지 아니한 경우에는 그러하지 아니하다. <개정 2022.1.21>

③ 제1항에 따른 보상비의 산정은 시장ㆍ군수등이 제9조제4항에 따라 빈집에 대한 직권 철거 결정을 빈집 소유자에게 통보한 시점을 기준으로 한다.
