비송사건절차법 제44조의13(신탁사채에 관한 사건)
Non-Contentious Case Procedure Act, Article 44-13 (Cases Concerning Trust Bonds)
수탁자가 「신탁법」 제87조제1항에 따라 사채(社債)를 발행한 경우에 관하여는 다음 각 호의 구분에 따른 규정을 준용한다.
Where a trustee has issued bonds under Article 87 (1) of the Trust Act, the following provisions shall apply mutatis mutandis, depending on the case:
1. 사채모집을 위탁받은 회사의 사임허가 신청과 해임청구 및 그 회사의 사무승계자 선임청구에 대한 재판: 제110조
1. Judicial decisions on applications for permission to resign, claims for removal, and claims for appointment of a successor of a company entrusted with bond subscription: Article 110;
2. 사채권자집회의 소집 허가신청: 제112조
2. Applications for permission to convene a bondholders' meeting: Article 112;
3. 사채권자집회의 결의 인가청구: 제113조
3. Claims for approval of resolutions of a bondholders' meeting: Article 113; and
4. 사채모집을 위탁받은 회사, 대표자 또는 집행자에게 줄 보수와 그 사무처리에 필요한 비용의 신탁재산 부담 허가신청: 제114조
4. Applications for permission to have trust property bear remuneration to be paid to a company entrusted with bond subscription, a representative, or an executor and expenses necessary for handling their affairs: Article 114.
