부패방지 및 국민권익위원회의 설치와 운영에 관한 법률 시행령 제71조(포상금의 지급사유 등)
Enforcement Decree of the Act on the Prevention of Corruption and the Establishment and Operation of the Anti-Corruption and Civil Rights Commission, Article 71 (Grounds for Paying Award Money, etc.)
① 법 제68조제1항에 따라 포상금을 지급할 수 있는 경우는 다음 각 호의 어느 하나에 해당하는 경우를 말한다. <개정 2019.10.15, 2020.12.29>
(1) Cases in which award money may be paid pursuant to Article 68 (1) of the Act are cases falling under any of the following:
1. 부패행위자에 대하여 공소제기, 기소유예, 기소중지, 수사중지(피의자중지로 한정한다), 징계처분 및 시정조치 등이 있는 경우
1. Where a person who committed a corrupt act has been prosecuted, had prosecution suspended, had prosecution deferred, had investigation suspended (limited to suspension for suspects), or been subject to disciplinary action or corrective measures, etc.;
2. 법령의 제정ㆍ개정 등 제도개선에 기여한 경우
2. Where the report has contributed to institutional improvement such as enactment or amendment of statutes;
3. 신고에 의하여 신고와 관련된 정책 등의 개선ㆍ중단 또는 종료 등으로 공공기관의 재산상 손실을 방지한 경우
3. Where, as a result of the report, a financial loss to a public institution has been prevented through improvement, suspension, or termination of a policy, etc. related to the report;

5. 그 밖에 포상금을 지급할 수 있다고 보상위원회가 인정하는 경우

② 제1항 각 호에 따른 포상금의 지급액은 5억원 이하로 한다. <개정 2009.5.28, 2015.10.20, 2019.10.15, 2022.7.19>
(2) The amount of award money to be paid under the subparagraphs of paragraph (1) shall not exceed 500 million won.
③ 위원회는 법 제68조제1항에 따라 포상금을 지급하려는 경우에는 다음 각 호의 사항을 고려하여 포상금의 지급금액을 감액하거나 포상금을 지급하지 않을 수 있다. <신설 2026.9.29>
(3) Where the Commission intends to pay award money pursuant to Article 68 (1) of the Act, it may reduce the amount of award money or refrain from paying it in consideration of the following:
1. 신고 내용의 정확성이나 증거자료의 신빙성
1. The accuracy of the content of the report and the credibility of evidentiary materials;
2. 신고한 부패행위가 신문ㆍ방송 등 언론매체에 의하여 이미 공개된 것인지 여부
2. Whether the reported corrupt act has already been made public by media such as newspapers and broadcasts;
3. 신고자가 신고와 관련한 불법행위를 하였는지 여부
3. Whether the reporter committed an illegal act in relation to the report;
4. 신고자가 부패행위의 제거 및 예방 등에 이바지한 정도
4. The degree to which the reporter contributed to eliminating and preventing corrupt acts;
5. 신고자가 관계 행정기관등에 신고할 의무를 가졌는지 또는 직무와 관련하여 신고를 하였는지 여부
5. Whether the reporter had a duty to report to relevant administrative agencies, etc., or made the report in connection with his or her duties.
④ 포상금 지급액의 결정에 관하여는 제80조를 준용한다. 이 경우 "보상금"은 "포상금"으로, "제77조에 따라 보상금을 산정할 때와 제79조에 따라 보상금의 지급 여부 및 지급금액을 결정할 때"는 "제79조에 따라 포상금의 지급 여부 및 지급액을 결정할 때"로, "제77조제2항에 따라 감액을 하는 경우"는 "제71조제3항에 따라 감액을 하는 경우"로 본다. <개정 2023.12.19, 2026.9.29>
(4) Article 80 applies mutatis mutandis to the determination of the amount of award money. In such cases, "reward money" is deemed "award money", "when calculating reward money under Article 77 and when deciding whether to pay reward money and the amount under Article 79" is deemed "when deciding whether to pay award money and the amount under Article 79", and "where reduced under Article 77 (2)" is deemed "where reduced under Article 71 (3)".
⑤ 제1항에 따른 포상금 지급사유가 2 이상에 해당되는 경우에는 그 중 액수가 많은 것을 기준으로 한다.
(5) Where two or more grounds for payment of award money under the subparagraphs of paragraph (1) apply, the ground yielding the largest amount shall be the basis.
