부동산투자회사법 제15조(주식의 분산)

① 주주 1인과 그 특별관계자는 제14조의8제2항에 따른 주식의 공모를 완료한 이후에는 부동산투자회사가 발행한 주식 총수의 100분의 50(이하 "1인당 주식소유한도"라 한다)을 초과하여 주식을 소유하지 못한다. <개정 2012.12.18, 2015.6.22, 2017.3.21, 2025.5.27>

② 주주 1인과 그 특별관계자(이하 "동일인"이라 한다)가 제1항을 위반하여 부동산투자회사의 주식을 소유하게 된 경우 그 주식의 의결권 행사 범위는 1인당 주식소유한도로 제한된다.

③ 국토교통부장관은 제1항을 위반하여 동일인이 1인당 주식소유한도를 초과하여 주식을 소유하는 경우에는 6개월 이내의 기간을 정하여 1인당 주식소유한도를 초과하는 주식을 처분할 것을 명할 수 있다. <개정 2013.3.23>

④ 제3항에도 불구하고 국토교통부장관은 동일인이 현물출자로 인하여 1인당 주식소유한도를 초과하여 주식을 소유하는 경우에는 현물출자에 따른 주식의 발행일부터 1년 이상 1년 6개월 이하의 기간을 정하여 1인당 주식소유한도를 초과하는 주식을 처분할 것을 명할 수 있다. <개정 2013.3.23>
