복권 및 복권기금법 시행령 제17조(복권수익금의 배분 및 용도)

① 법 제23조제1항 각 호 외의 부분 본문에 따른 복권수익금 배분비율은 다음 각 호와 같다. <개정 2016.1.22, 2019.4.2, 2024.5.7>

② 복권위원회는 법 제23조제1항 각 호 외의 부분 단서에 따라 제1항 각 호에 따른 배분비율을 가감 조정할 때에는 다음 각 호의 사항을 반영하여야 한다.

③ 복권위원회는 제2항에 따라 같은 항 각 호의 사항을 반영할 때에는 같은 항 제2호에 따른 성과평가 결과를 우선적으로 반영하여야 한다.

④ 제2항 및 제3항에서 정한 사항 외에 제2항 각 호의 사항을 반영하는 기준 및 방법, 가감 조정률의 산출방법 등 가감 조정에 필요한 세부 사항은 복권위원회의 의결을 거쳐 정한다.

⑤ 법 제23조제3항제5호에서 "대통령령으로 정하는 사업"이란 「자연재해대책법」 제2조제1호에 따른 재해 및 「재난 및 안전관리 기본법」 제3조제1호에 따른 재난 등에 대한 지원사업으로서 복권위원회가 의결하는 사업을 말한다.

⑥ 복권위원회는 「국가재정법」에 따른 기금운용계획이 국회에서 확정되면 복권기금의 월별 수입 및 지출계획서와 분기별 집행계획서를 작성하고 이에 따라 자금을 배분하여야 한다. 이 경우 법 제23조제1항 및 제3항에 따라 복권수익금 및 복권기금을 배분받는 기금 등의 재원소요와 자금사정 등을 고려하여 배분시기 및 배분액을 조정할 수 있다.

⑦ 복권위원회는 법 제23조제1항에 따라 기금등에 배분하여야 할 금액과 제6항에 따라 기금등에 배분된 금액에 차액이 발생한 경우에는 그 차액을 늦어도 다음다음 연도의 기금운용계획에 반영하여야 한다. 이 경우 해당 차액을 기금등에 배분하는 비율은 해당 연도에 법 제23조제1항 각 호 외의 부분 단서에 따라 조정된 비율에 따른다.
