보훈보상대상자 지원에 관한 법률 제8조(보상받을 권리의 발생시기 및 소멸시기 등)

① 이 법에 따라 보상을 받을 권리는 제4조제1항에 따른 등록신청을 한 날이 속하는 달부터 발생한다. 다만, 제2조제1항제2호 또는 제4호에 해당하는 사람으로서 전역ㆍ퇴직 전 제4조제1항에 따라 등록을 신청하는 경우에는 전역일ㆍ퇴직일 다음 날이 속하는 달부터 해당 보상을 받을 권리가 발생한다. <개정 2020.3.24>

② 제1항에도 불구하고 제14조제1항ㆍ제3항 및 제25조제4항에 따라 생활조정수당 지급 및 교육지원을 신청하는 경우에는 그 신청한 날이 속하는 달부터 해당 보상을 받을 권리가 발생한다. 다만, 제2조제1항제2호 또는 제4호에 해당하는 사람으로서 전역ㆍ퇴직 전 제14조제1항ㆍ제3항 및 제25조제4항에 따라 생활조정수당 지급 및 교육지원을 신청하는 경우에는 전역일ㆍ퇴직일 다음 날이 속하는 달부터 해당 보상을 받을 권리가 발생한다. <신설 2020.3.24, 2024.2.13>

③ 보훈보상대상자, 그 유족 또는 가족이 제5조제1항제1호부터 제3호까지, 제72조제1항 및 제2항의 어느 하나에 해당하게 되면 그 해당되는 사유가 발생한 날이 속하는 달의 다음 달부터 이 법에 따라 보상을 받을 권리가 소멸된다. 이 경우 보훈보상대상자 본인이 제5조제1항제2호 또는 제72조제1항에 해당하게 되는 경우에는 그 가족이 보상을 받을 권리도 함께 소멸된다. <개정 2020.3.24>

④ 보훈보상대상자, 그 유족 또는 가족이 다음 각 호의 어느 하나에 해당하면 이 법에 따라 보상을 받을 권리가 발생하였던 날로 소급하여 그 권리가 소멸된다. 이 경우 보훈보상대상자 본인이 보상을 받을 권리가 소멸된 경우에는 그의 유족 또는 가족이 보상을 받을 권리도 함께 소멸된다. <개정 2020.3.24>

⑤ 국가보훈부장관은 제4항 각 호의 어느 하나에 해당하는지를 판정할 때에는 그와 관련된 사실을 조사ㆍ확인하여 보훈심사위원회의 심의ㆍ의결을 거쳐야 한다. <개정 2020.3.24, 2023.3.4>

⑥ 제4조제3항 후단에 따른 소속하였던 기관의 장은 제4항 각 호의 어느 하나에 해당하는 사실을 알게 되면 지체 없이 그 내용을 국가보훈부장관에게 통보하여야 한다. <개정 2020.3.24, 2023.3.4>
