Enforcement Decree of the Military Service Act, Article 155-4 (Management of the Military Registers of Public Officials, etc.)
① 법 제77조의4제1항제4호에서 "대통령령으로 정하는 사람"이란 「소득세법」 제55조제1항에 따라 종합소득과세표준별로 적용되는 세율 중 최고 세율 또는 최고 세율 다음으로 높은 세율을 적용받는 사람을 말한다. <개정 2017.9.22, 2023.12.19>
(1) "Persons prescribed by Presidential Decree" in Article 77-4 (1) 4 of the Act means persons to whom the highest tax rate, or the next highest tax rate, among the rates applied by tax base bracket for global income under Article 55 (1) of the Income Tax Act applies.
② 법 제77조의4제5항 단서에서 "외관상 명백한 신체적 장애가 있는 경우 등 대통령령으로 정하는 기준"이란 다음 각 호의 어느 하나에 해당하는 경우를 말한다. <신설 2025.9.18>
(2) "Criteria prescribed by Presidential Decree, such as where there is an obvious physical disability" in the proviso to Article 77-4 (5) of the Act means any of the following cases:
1. 왜소증이 있거나 코 또는 양쪽 귀가 없는 경우
1. Where the person has dwarfism or has no nose or no ears;
2. 사지의 마비나 단축으로 운동장애가 심한 경우
2. Where the person has a severe motor disability due to paralysis or shortening of the limbs;
3. 보건소에 한센병 환자 또는 인체면역결핍바이러스 감염인으로 등록된 경우
3. Where the person is registered at a public health center as a Hansen's disease patient or a person infected with human immunodeficiency virus;
4. 손가락이나 발가락 중 3개 이상이 없는 경우
4. Where the person is missing three or more fingers or toes;
5. 악성 혈액질환(재생불량성 빈혈, 백혈병, 골수이형성증후군, 악성 림프종 또는 관해 후 5년 이상 경과한 혈액암으로 한정한다), 선천성 면역결핍질환, 애디슨씨병 또는 랑게르한스조직구증(전신적 항암치료로 치료한 경우로 한정한다)으로 확진된 경우
5. Where the person has been definitively diagnosed with a malignant blood disease (limited to aplastic anemia, leukemia, myelodysplastic syndrome, malignant lymphoma, or blood cancer for which five years or more have passed since remission), a congenital immunodeficiency disease, Addison's disease, or Langerhans cell histiocytosis (limited to cases treated with systemic anticancer therapy).
③ 법 제77조의4제6항 전단에서 "진료기록을 요청할 수 있는 구체적 사유"란 다음 각 호의 어느 하나에 해당하는 경우를 말한다. <신설 2025.9.18>
(3) "Specific grounds on which medical records may be requested" in the former part of Article 77-4 (6) of the Act means any of the following cases:
1. 병역처분의 원인이 된 질병 또는 심신장애가 병역면탈에 이용되었던 사례가 있는 경우로서 병무청장이 정하는 경우
1. Where the disease or mental or physical disability on which the service disposition was based has been used in past cases of unlawful evasion of military service, as determined by the Commissioner of the Military Manpower Administration;
2. 병역처분의 원인이 된 질병 또는 심신장애가 계속 치료를 받아야 하는 질병 또는 심신장애에 해당하는 경우로서 병무청장이 정하는 경우
2. Where the disease or mental or physical disability on which the service disposition was based is one requiring continued treatment, as determined by the Commissioner of the Military Manpower Administration.
④ 법 제77조의4제6항 전단에서 "진료기록의 범위"란 다음 각 호의 구분에 따른 자료를 말한다. <신설 2025.9.18>
(4) "Scope of medical records" in the former part of Article 77-4 (6) of the Act means the following materials, by category:
1. 「의료법」에 따른 의료기관의 장: 같은 법 제22조에 따른 진료기록부등
1. The head of a medical institution under the Medical Service Act: medical records, etc. under Article 22 of the same Act;
2. 「국민건강보험법」 제13조에 따른 국민건강보험공단의 장: 같은 법 제47조에 따른 요양급여비용의 청구와 지급에 관한 정보 중 진료이력에 관한 자료
2. The President of the National Health Insurance Service under Article 13 of the National Health Insurance Act: materials on medical treatment history among information on claims for and payment of costs of health care benefits under Article 47 of the same Act;
3. 「국민건강보험법」 제62조에 따른 건강보험심사평가원의 장: 같은 법 제47조에 따른 요양급여비용의 청구와 지급에 관한 정보 중 약제의 처방 및 조제에 관한 자료
3. The President of the Health Insurance Review and Assessment Service under Article 62 of the National Health Insurance Act: materials on the prescription and dispensing of drugs among information on claims for and payment of costs of health care benefits under Article 47 of the same Act.
⑤ 병무청장 또는 지방병무청장은 법 제77조의4에 따른 병적 관리 대상자 관리, 변동사항 확인 및 병역처분의 원인이 된 질병이나 심신장애의 확인을 위하여 다음 각 호의 자료를 해당 기관 또는 단체의 장에게 우편 또는 정보통신망 등을 이용하거나 방문하여 요청할 수 있다. 이 경우 자료의 제공을 요청받은 기관 또는 단체의 장은 14일 이내에 해당 자료를 병무청장 또는 지방병무청장에게 제출하여야 한다. <신설 2017.9.22, 2025.9.18>
(5) The Commissioner of the Military Manpower Administration or the Regional Military Manpower Commissioner may request the following materials from the head of the relevant agency or organization, by mail, through an information and communications network, etc., or by visiting, in order to manage persons whose military registers are managed under Article 77-4 of the Act, check changes, and confirm the disease or mental or physical disability on which a service disposition was based. In such cases, the head of the agency or organization requested to provide materials shall submit them to the Commissioner of the Military Manpower Administration or the Regional Military Manpower Commissioner within 14 days:
1. 법 제77조의4제2항 각 호의 자료
1. The materials under the subparagraphs of Article 77-4 (2) of the Act;
2. 법 제77조의4제6항 및 이 조 제4항 각 호의 자료
2. The materials under Article 77-4 (6) of the Act and the subparagraphs of paragraph (4) of this Article.
⑥ 병무청장은 법 제77조의4에 따른 병적 관리를 위하여 따로 데이터베이스를 구축ㆍ운영할 수 있다. <신설 2017.9.22, 2025.9.18>
(6) The Commissioner of the Military Manpower Administration may build and operate a separate database for managing military registers under Article 77-4 of the Act.
⑦ 제1항부터 제6항까지의 규정 및 제155조의5 외에 법 제77조의4에 따른 공직자 등의 병적 관리의 세부 절차 및 방법 등에 관하여 필요한 사항은 병무청장이 정한다. <개정 2017.9.22, 2025.9.18>
(7) Except as provided in paragraphs (1) through (6) and Article 155-5, matters necessary for the detailed procedures, methods, etc. for managing the military registers of public officials, etc. under Article 77-4 of the Act shall be determined by the Commissioner of the Military Manpower Administration.
