백두대간 보호에 관한 법률 시행령 제11조의5(소득감소분의 지원신청 및 지급절차)

① 제11조의3에 따른 소득감소분의 지원대상자(이하 "지원대상자"라 한다)가 지원을 받으려는 경우에는 별지 제3호서식의 소득감소분 지원신청서(이하 "지원신청서"라 한다)에 입목등기부 등본(등기된 입목의 소유자만 해당한다)을 첨부하여 산림소재지 관할 시장ㆍ군수에게 제출하여야 한다. 이 경우 시장ㆍ군수는 「전자정부법」 제36조제1항에 따른 행정정보의 공동이용을 통하여 다음 각 호의 서류를 확인하여야 한다. <개정 2009.6.16, 2010.5.4, 2014.9.11>

②시장ㆍ군수는 제1항의 규정에 의하여 지원신청서를 접수한 때에는 해당 산림에 대한 현지조사를 실시하여 제11조의4의 규정에 의한 소득감소분 지원금액(이하 "지원금액"이라 한다)을 산출하여야 한다.

③시장ㆍ군수는 제2항의 규정에 따라 산출한 지원금액과 지급시기를 지원대상자에게 통지하여야 한다.

(3) The^ð더 head헤드 of어^v브 the^ð더 Si/Gun시 shall섈 notify노우터^f파이 the^ð더 person퍼슨 eligible엘러저블 for^f포 support서포트 of어^v브 the^ð더 support서포트 amount어마운트 calculated캘큘레이티드 under언더 paragraph패^r러그^r래^f프 (2) and앤드 the^ð더 time타임 of어^v브 payment.페이먼트

④시장ㆍ군수는 제1항의 규정에 의한 지원신청 내용과 제2항의 규정에 의한 지원금액 산출 내용을 도지사에게 제출하여야 하며, 도지사는 이를 종합하여 지원대상연도 12월말까지 산림청장에게 제출하여야 한다.

⑤산림청장은 제4항에 따라 제출받은 내용에 따라 지원신청자에게 지원금액을 지급하여야 한다. <개정 2007.10.15>

⑥제2항 내지 제5항의 규정에 의한 현지조사, 지원금액 산출 및 지급절차 등에 관하여 필요한 세부사항은 산림청장이 정한다.

⑦소득감소분의 지원대상기간은 지원신청서가 접수된 날부터 벌채허가 또는 신고일(벌채를 하기 전에 소유권이 변경된 경우에는 그 변경일을 말한다)까지를 대상으로 하되, 지원신청서가 접수된 연도에는 그 접수된 날이 속하는 달부터 기산하고, 벌채를 하거나 소유권이 변경된 연도의 경우에는 벌채허가ㆍ신고일 또는 소유권 변경일이 속하는 달의 전월까지를 대상으로 월할계산한다.
