발명진흥법 제50조의5(특허공제사업의 위탁 및 자금의 조성 등)
Invention Promotion Act, Article 50-5 (Entrustment of Patent Mutual Aid Program and Raising of Funds)
① 지식재산처장은 특허공제사업을 효율적으로 운영하기 위하여 다음 각 호의 기관 또는 단체에 사업 운영을 위탁할 수 있다. <개정 2025.10.1>
(1) To efficiently operate the patent mutual aid program, the Minister of Intellectual Property may entrust its operation to any of the following institutions or organizations:
1. 「중소기업협동조합법」에 따른 중소기업중앙회
1. The Korea Federation of Small and Medium Businesses under the Small and Medium Enterprise Cooperatives Act;
2. 그 밖에 대통령령으로 정하는 기관 또는 단체
2. Other institutions or organizations prescribed by Presidential Decree.
② 특허공제사업 운영을 위한 자금은 다음 각 호의 재원으로 조성한다.
(2) Funds for operating the patent mutual aid program shall be raised from the following sources:
1. 가입자가 납부하는 공제부금
1. Mutual aid premiums paid by subscribers;
2. 기업, 지식재산 관련 기관ㆍ단체, 그 밖의 자의 출연금
2. Contributions from enterprises, intellectual property-related institutions and organizations, and others;
3. 초기 운영비 충당을 위한 정부의 출연금 또는 보조금
3. Government contributions or subsidies to cover initial operating costs;
4. 그 밖에 대통령령으로 정하는 재원
4. Other sources prescribed by Presidential Decree.
③ 제1항 및 제2항에서 규정한 사항 외에 특허공제사업 운영에 필요한 사항은 대통령령으로 정한다.
(3) Matters necessary for operating the patent mutual aid program, other than those provided for in paragraphs (1) and (2), shall be prescribed by Presidential Decree.
