Enforcement Decree of the Water Environment Conservation Act, Article 41 (Standards and Method for Calculating Basic Discharge Charge)

①법 제41조제1항제1호가목 및 나목에 따른 기본배출부과금(이하 "기본배출부과금"이라 한다)은 수질오염물질 배출량과 배출농도를 기준으로 다음의 계산식에 따라 산출한 금액으로 한다.기준 이내 배출량 × 수질오염물질 1킬로그램당 부과금액 × 연도별 부과금산정지수 × 사업장별 부과계수 × 지역별 부과계수 × 방류수수질기준초과율별 부과계수

③ 기본배출부과금의 산정에 필요한 수질오염물질 1킬로그램당 부과금액에 관하여는 제45조제5항을 준용하고, 연도별 부과금산정지수에 관하여는 제49조제1항을 준용하며, 사업장별 부과계수는 별표 9, 지역별 부과계수는 별표 10, 방류수수질기준초과율별 부과계수는 별표 11과 같다.

④ 공동방지시설의 기본배출부과금은 사업장별로 제1항부터 제3항까지의 규정에 따라 산정한 금액을 더한 금액으로 한다.

⑤ 법 제38조의2에 따라 측정기기를 부착하고 관제센터에 자동측정자료를 전송하는 측정기기부착사업장등의 경우에는 제1항에 따른 수질오염물질 배출량과 배출농도를 다음 각 호의 구분에 따른 자료로 산정한다. <개정 2010.2.18, 2023.4.4>

나. 법 제39조에 따른 개선명령 기간 중이거나 제40조에 따른 개선계획서(배출시설 또는 방지시설의 개선계획서만 해당한다)에 명시된 개선기간 중인 경우: 개선명령 기간 또는 개선기간 중에 자동측정자료가 정상적으로 측정ㆍ전송된 최근 3개월 간의 24시간 평균치를 산술평균한 값. 다만, 정상적인 자동측정자료가 없는 경우에는 개선명령에 명시된 수질오염물질의 배출량 및 배출농도나 제40조제1항에 따른 개선계획서 제출 시에 제40조제3항에 따라 채취하여 검사한 수질오염물질의 배출량 및 배출농도로 산정한다.
