물환경보전법 시행령 제45조(초과배출부과금의 산정기준 및 산정방법)

①법 제41조제1항제2호에 따른 초과배출부과금(이하 "초과배출부과금"이라 한다)은 수질오염물질 배출량 및 배출농도를 기준으로 다음 계산식에 따라 산출한 금액에 제3항 각 호의 구분에 따른 금액을 더한 금액으로 한다. 다만, 법 제41조제1항제2호가목에 따른 초과배출부과금을 부과하는 경우로서 배출허용기준을 경미하게 초과하여 법 제39조에 따른 개선명령을 받지 아니한 측정기기부착사업자등에게 부과하는 경우 또는 제40조제1항제2호에 따라 개선계획서를 제출하고 개선하는 사업자에게 부과하는 경우에는 배출허용기준초과율별 부과계수와 위반횟수별 부과계수를 적용하지 아니하고, 제3항제1호의 금액을 더하지 아니한다. <개정 2010.2.18>기준초과배출량 × 수질오염물질 1킬로그램당 부과금액 × 연도별 부과금산정지수 × 지역별 부과계수 × 배출허용기준초과율별 부과계수(법 제41조제1항제2호나목의 경우에는 유출계수ㆍ누출계수) × 배출허용기준 위반횟수별 부과계수

② 제40조제1항제1호에 따라 개선계획서를 제출하고 개선한 사업자에 대하여 제1항에 따른 산정기준을 적용함에 있어서는 법 제39조에 따른 개선명령을 받은 것으로 본다.

③ 초과배출부과금을 산출하기 위하여 제1항의 산식에 따라 산출한 금액에 더하는 금액은 다음 각 호와 같다.

④ 제1항의 산식에 따른 기준초과배출량은 다음 각 호의 구분에 따른 배출량으로 한다.

⑤ 제1항과 제4항에 따른 초과배출부과금 산정에 필요한 수질오염물질 1킬로그램당 부과금액, 배출허용기준초과율별 부과계수, 유출ㆍ누출계수 및 지역별 부과계수는 별표 14와 같다.

⑥ 공동방지시설에 대한 초과배출부과금은 사업장별로 제1항부터 제4항까지의 규정에 따라 산정하여 더한 금액으로 한다.

⑦ 측정기기부착사업장등에 대한 초과배출부과금 산정을 위한 수질오염물질 배출량과 배출농도에 관하여는 제41조제5항을 준용한다.
