Enforcement Decree of the Act on the Protection and Utilization of Cultural Heritage, Article 42 (Delegation of Authority)
① 국가유산청장은 법 제82조에 따라 궁능유적본부장의 소관 문화유산에 관한 다음 각 호의 권한을 궁능유적본부장에게 위임한다. <개정 2024.5.7, 2025.7.8>
(1) Pursuant to Article 82 of the Act, the Administrator of the Korea Heritage Service delegates the following authority over cultural heritage under the jurisdiction of the Director General of the Royal Palaces and Tombs Center to the Director General of the Royal Palaces and Tombs Center:
1. 법 제35조(법 제47조에 따라 준용되는 경우를 포함한다)에 따른 허가 또는 변경허가
1. Permission or permission for change under Article 35 of the Act (including cases applied mutatis mutandis under Article 47 of the Act);
2. 법 제37조(법 제47조에 따라 준용되는 경우를 포함한다)에 따른 허가 취소
2. Revocation of permission under Article 37 of the Act (including cases applied mutatis mutandis under Article 47 of the Act);
3. 법 제39조(법 제47조에 따라 준용되는 경우를 포함한다)에 따른 국외 반출 허가
3. Permission for taking out of the country under Article 39 of the Act (including cases applied mutatis mutandis under Article 47 of the Act);
4. 법 제40조(법 제47조에 따라 준용되는 경우를 포함한다)에 따른 신고의 수리
4. Acceptance of reports under Article 40 of the Act (including cases applied mutatis mutandis under Article 47 of the Act);
5. 법 제42조(법 제47조에 따라 준용되는 경우를 포함한다)에 따른 행정명령
5. Administrative orders under Article 42 of the Act (including cases applied mutatis mutandis under Article 47 of the Act);
6. 법 제48조에 따른 국가지정문화유산의 공개 및 공개 제한
6. Opening to the public and restriction of opening of nationally designated cultural heritage under Article 48 of the Act;
7. 법 제49조에 따른 관람료의 징수 및 감면
7. Collection and reduction of admission fees under Article 49 of the Act;

11. Imposition and collection of administrative fines under Article 103 (1) 3, Article 103 (3) 1, Article 103 (4) 1, or Article 103 (5) of the Act.
② 국가유산청장은 법 제82조에 따라 다음 각 호의 권한을 시ㆍ도지사에게 위임한다. <개정 2024.5.7>
(2) Pursuant to Article 82 of the Act, the Administrator of the Korea Heritage Service delegates the following authority to the Mayor/Do Governor:
1. 법 제87조제1항제3호에 따른 허가 또는 변경허가를 위한 협의
1. Consultation for permission or permission for change under Article 87 (1) 3 of the Act;
2. 제47조제2항에 따른 통지
2. Notification under Article 47 (2).
